GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. This year's 12 Hours of Sebring wasn't exactly a foregone conclusion because we're still talking about racing, and anything can happen when the speeds are as high as the adrenaline and the desire. But we're still talking about Audi bringing it's two top-spec racers - and its huge budget and its nearly neurotic attention to detail - to a race that it uses as a test bed for The 24 Hours of Le Mans and as a way to open the endurance racing season with a victory.
Besides, 12 hours is a long time, especially at Sebring, and things didn't go all Audi's way. On top of that, although it was a pretty quiet race, behind the Audis things got even grimier, with plenty of battles, plenty of mechanical issues, and the new BMW Z4 GTE and Viper GTS-R being race tested. Oh, and that brand new chromed-out DeltaWing...

Michael Jordan's cars showcased in 'The Last Dance' documentary

After the masses begged and pleaded for an early release, ESPN finally unlocked the doors to the biggest production in company history last month. Episodes 1 and 2 of The Last Dance, a 10-part documentary special about Michael Jordan, the Chicago Bulls, and the 1997-1998 season, was released at last on April 19, 2020. Each week since, two new episodes have aired on Sunday nights, and the next two, episodes 7 and 8 are scheduled to drop this weekend on May 10. With unprecedented video access to MJ, who became averse to the media during his playing days, a byproduct from The Last Dance is a look at some of Jordan's cars. The Goat's taste ranges across a number of brands, but they all had one thing in common: performance as a top priority. Below, we have listed the rides that have already appeared in the series, and each week, we will update with new car cameos. Chevrolet Corvette C4 The photo above somewhat epitomizes one of the themes of The Last Dance. Everybody, whether that was men, women, children, franchise owners, reporters, coaches, teammates, or opponents, wanted a piece of Jordan. If that meant stopping in the middle of the road to get an autograph, then so be it. Around town, MJ was fairly easy to spot due to his flashy cars that occasionally wore Bulls red. Jordan has driven numerous Corvettes throughout the years, but the C4 is unique in that it was Chevy's top ride when Jordan signed an endorsement deal with the American company during his rookie year in 1984. Two famous photos, one in front of the Chicago skyline, show him standing next to a C4 with the license plate "Jump 23." This exact car, however, came later, as indicated by the squared-off taillights. He went on to star in a number of Chevrolet commercials with vehicles such as the Blazer and S-10 pickup truck. Chevrolet Corvette C5 The most notable Corvette His Airness ever owned was likely the C4 40th Anniversary ZR-1, but he also drove a C5 coupe at one point. Roughly nine minutes into the first episode, Jordan is seen driving the chrome-wheeled targa top into the parking lot at the Berto Center, the Bulls old practice facility.   Ferrari 550 Maranello Roughly three minutes into episode four, viewers get a glimpse of Jordan's exotic taste in the form of a red Ferrari 550 Maranello.
