GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. But open-top motoring doesn't need to be a wallet killer. The Mini is cheap (at least by 2022 standards) and an absolute joy to drive, so there's really no downside here ... except for the roof. Get it?    For the hardtop lover: 2022 Mazda MX-5 RF ($37,260) / 2022 Chevrolet Corvette Convertible ($69,695) The number of hardtop convertibles has seriously dwindled due to weight concerns and the fact that fabric roofs have gotten so quiet, but there are still some options for those who prefer a more coupe-like look with the roof up. Our picks here are the delightfully Targa-like MX-5 Miata RF and literally any Corvette Stingray — even the hardtop has a removable roof!    For long road trips: 2022 Ford Mustang Convertible ($34,100) The first image that comes to mind for many who are told to visualize an American convertible is the classic Ford Mustang. It's not the only drop-top pony car out there, but thanks to the Camaro's tiny trunk, it's much harder to see the USA in a Chevrolet when a drop-top enters the equation. The Mustang has much more cargo space and a much larger opening, which is likely the difference between keeping your bags under lock and key or leaving them exposed in the back seat.    For towing behind an RV: 2022 Jeep Wrangler ($31,590) While many small runabouts make sense for towing behind a motor home (or nestled up inside a fancier one), the Wrangler has a serious advantage when it comes to RVing: it can easily be flat-towed.

2014 Chevrolet Corvette Stingray convertible headed for Geneva debut

While most of the world is still coming down from all the hype surrounding the debut of the 2014 Chevrolet Corvette Stingray at the Detroit Auto Show earlier this month, we're already looking to the future. And according to Autoweek, the next chapter in the C7 story will unfold at the Geneva Motor Show in March. That's right, General Motors is reportedly using the Swiss stage as its venue to debut the Corvette Stingray convertible.
If this strikes you as odd, you aren't alone. After all, with a car that's such an American icon, we'd fully expect Chevrolet to unveil it here on our shores in either Chicago or New York. But according to Autoweek, GM is looking to boost export sales of its halo car, and since the C7 was engineered to compete with the world's best and brightest, showing it off in Geneva is somewhat of a smart move. What's more, those with sharp memories will recall that GM used the Geneva expo to debut the sixth-generation C6 Corvette convertible back in March 2004, so there's also a precedent.
Details surrounding the Corvette Stingray convertible are still slim, though we fully expect the 6.2-liter V8 and choice of either six-speed automatic or seven-speed manual transmissions to carry over unchanged. Prototypes spotted on the road showed the car fitted with a cloth convertible roof, as well.
