GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Recharge Wrap-up: 'Racing Extinction' Tesla, Wards praises 3 hybrids

The makers of Racing Extinction used a tricked out Tesla Model S for their movie. The artists and activists used the electric car as a platform to project images from nature in various cities to raise awareness about imperiled wildlife. In addition to a the high-powered projector, the Model S features a electroluminescent paint job that emits light to mimic creatures found in the wild, such as bioluminescent sea life. WardsAuto has named the 2016 Hyundai Sonata Plug-In Hybrid's powertrain to its list of 10 Best Engines. As the first plug-in hybrid to make the list, WardsAuto World Editor-in-Chief Drew Winter praises Hyundai engineers for their "impeccable job blending fuel efficiency with refinement and daily usability." Wards notes the car's smooth transitions between electric and hybrid modes, and a well-connected six-speed automatic transmission. FEV's plug-in hybrid battery pack has gone into vehicle series production. The 10-kWh battery pack, developed by the German development services provider, offers an all-electric range of about 30 miles. FEV says its battery management algorithms are just as important as choosing the right battery hardware. "The core system for the battery development is our own mature battery management system (BMS), now in its third generation, that together with optimized algorithms allows a very reliable and stable control of the battery," says FEV's Dr. Michael Stapelbroek. Hybrid Vehicle Goes Into Series Production FEV development competence consists of batteries, controls, as well as complete drive systems FEV has demonstrated competence in the development of alternative drive concepts for almost twenty years. Most recently, yet another plug-in hybrid vehicle has gone into series production with technology provided by the Aachen-based developer. In addition to using an innovative transmission concept which is based on a FEV patent, FEV also developed the battery technology of the plug-in hybrid vehicle to series production readiness.

There's going to be tons of car news next week as the Detroit Auto Show makes its return after 48 years. OK, so the pandemic and the show's shifting calendar only made it feel like 48 years, but January 2019 was still a long time ago. As we await that wave of headlines, let's look back at the substantial week that already was, specifically in terms of the electric car news that broke. Electric Jeep Recon and Wagoneer S blaze trail to brand's EV future Jeep declared Thursday to be 4xe Day as it revealed loads of previously unknown information about its future electrification efforts. The biggest surprise was the extremely cool and 100% electric Jeep Recon. Although it looks like a Wrangler, it's absolutely not a Wrangler replacement, and is indeed quite different for reasons besides its powertrain (independent front and rear suspension, fully enclosed fenders, fixed roof). As the photos attest, though, you'll be able to remove the doors and rear-quarter windows just like a Wrangler. And again, it's electric. Expect the Recon to be one of the most eagerly anticipated new vehicles over the next couple of years. Yes, years, plural. Production will start in 2024 with reservations accepted starting early next year. Jeep Recon View 5 Photos   There was then the Wagoneer S. Despite the name, it isn't a sportier Wagoneer variant or even an electric Wagoneer. In fact, the name is temporary according to chief designer Ralph Gilles. This sleek SUV, which sure looks like Jeep's attempt at a Range Rover Vilar (not a bad thing), will apparently have a 600-horsepower electric powertrain. It too will be produced in North America starting in 2024 with reservations starting early next year. Jeep Wagoneer S View 4 Photos   There actually WILL be an electrified Wagoneer, however: the Grand Wagoneer 4xe PHEV. That's good since the Grand Wagoneer gets pretty atrocious fuel economy. Details were light regarding specs, but we did get a half-decent photo. Finally, the first of these electrified Jeeps to launch will be the Avenger. Yes, Chrysler/Stellantis is dusting off an old Dodge name for a Jeep. That Dodge in question wasn't sold in Europe, though (good for them), which is important since the Jeep Avenger will only be sold on the other side of the pond. It's mechanically based on the same platform as several French Stellantis EV SUVs, and only goes 249 miles on the far more generous European WLTP test cycle.
