GM isn't liable for punitive damages in ignition switch cases
Wed, Nov 20 2019NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. The Opel GT is the concept General Motors should build for the US
Sat, Feb 27 2016Now is the time. General Motors should double-down on performance cars and build the Opel GT concept that's set to debut next week at the Geneva Motor Show. Better yet, sell it in the United States as the Chevy GT. Consumers are showing a thirst for performance cars not seen in decades. Ford has them coming in waves, with everything from the F-150 Raptor to a hotted-up Fusion. FCA US is unrepentantly building loads of Hellcats. GM should respond. The General's cupboard is hardly bare. With the Corvette, Camaro, and Cadillac's V-Series, GM has more than enough to compete with its crosstown rivals and anything Europe or Japan can throw at it. But there's also an opportunity. There's not many front-mid-engine, rear-wheel-drive, two-seat sports cars out there like the Opel GT concept. A Chevy GT that used that layout and captured some of the concept car's proportions and curves would ignite a different kind of passion in enthusiasts. It would be Miata-like. With Chevy branding, this sports car would be the everyday exotic. The concept has a turbocharged 1.0-liter three-cylinder engine, which makes about 143 horsepower to motivate a structure that weighs less than 2,200 pounds. It can hit 60 miles per hour in less than eight seconds. All of those numbers are within the front-engined Miata's territory. This new Opel is inspired by two great mid-1960s concepts that helped put its design studio, and that of its sister brand, the British Vauxhall, on the map. (The GT concept is also technically a Vauxhall, as the brands are linked in GM's European strategy.) One of them, the '66 Vauxhall XVR remained a concept. The '65 Opel Experimental GT was on the road by 1968. That shows this is doable. There's precedent. The Saturn Sky and Pontiac Solstice shared a chassis with a modern GT during that trio's brief run. If GM ever makes this concept, Opel and Vauxhall should get their versions. But Chevy is the one that could make this car a global icon. Chevrolet GT. Make it happen. Chevy rolls out Silverado HD High Country
Wed, 09 Apr 2014It's been a good week for heavy-duty truck buyers. First, Ram revealed the Black Package for its HD trucks, then it rolled out its new Power Wagon, and now Chevy's getting in on the action with its Silverado High Country HD. Okay, so it may not pack quite the attitude of Ram's latest 2500-series offerings, but the High Country HD will come as a welcome addition to the Chevy Trucks range to those looking to pull their horse, boat or other trailer without skimping on creature comforts.
Rolled out a little under a year ago, the High Country trim is Chevy's answer to the likes of the GMC Denali, Ford King Ranch and Ram Longhorn. It has until now only been offered on the light duty, 1500-series Silverado, but now extends to the 2500 and 3500-series HD models, as well.
So what sets a High Country pickup apart from lesser Chevy trucks? You'll be able to pick it out based on its chrome horizontal grille, body-color bumpers, 6-inch tubular side steps, 20-inch chrome wheels (18-inch on the 3500 and 17-inch on the dualie) and, of course, plenty of special badging. But it's inside where the High Country makes its mark, with a cabin decked out in saddle brown perforated leather, seats that are both heated and cooled, eight-inch touchscreen with full MyLink suite, Bose audio and park assist functions front and rear to keep those color-keyed bumpers looking fresh. (Though Chevy hasn't yet showed us the interior of the HD model, it'll presumably look mostly the same as the cab in the 1500 High Country in the gallery below.)
