GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Europeans ask Chevy to bring Volt back to Europe

A group of French fans is asking for a jolt of support from General Motors to get the 2016 Chevrolet Volt across the pond. The Association Amperistes et Amis des Vehicules Rechargeables is running a Change.org petition that currently has 383 signatures out of a goal of 500. While the attempt is admirable, it's probably going to take a lot more than several hundred people for the model to make a return to the continent after the poor showing of the Opel Ampera – first-gen Volt's European cousin. The group's major argument for bringing a version of the second-gen Volt to Europe is that consumers need "an intermediate choice between expensive or range-limited pure electric cars and plug-in hybrids with a miserable electric range." Furthermore, such a vehicle would prod the competition to produce similarly efficient electrified models. They also lavish praise on the abilities of the Ampera for its long EV driving range. The supporters aren't entirely kind to GM in the petition, though, and claim the company excluded the original car from marketing efforts there. The Ampera actually enjoyed a strong European launch with more orders than initially expected and briefly topped the best-sellers list among EVs there. It was even named 2012 European Car of the Year. Those halcyon days didn't last long, and by 2014 sales fell off to a trickle. 2019 GMC Sierra revealed with CarbonPro bed and new diesel engine

It's only March, and it's already been one hell of a year for trucks. January's Detroit Auto Show saw the reveals of the 2019 Ram 1500, 2019 Ford Ranger and the 2019 Chevy Silverado. The Chicago Auto Show brought new versions of the Toyota Tacoma and Toyota Tundra TRD Pro. Today, we finally got our first look at the Silverado's twin, the 2019 GMC Sierra. The truck features new styling, a new diesel engine and — on the Sierra Denali — a carbon fiber bed. As with every new full-size truck, the Sierra is larger than the outgoing model in almost every dimension, though exact dimensions haven't been revealed. For reference, though, the Chevy Silverado's bed is 7-inches wider than before. The new Sierra grille is more upright than before and features new C-shaped lighting. The Denali gets LED headlights, tail lights and fog lights. Both SLT and Denali trims get unique 22-inch wheels. As we saw in spy photos, the Sierra's interior is mostly just a copy of the Silverado's with some chrome accents sprinkled throughout. If you like the current truck interiors, you'll be pleased with the new model. Those hoping for a wholesale change will be left wanting. The big improvements inside include a full-color heads-up display, trailer hitch assist apps and cameras, and the rear-camera mirror found in models like the Chevy Traverse and Cadillac CT6. Safety and convenience features include a surround-view camera, blind-spot monitoring, pedestrian detection and low-speed automatic braking. Like the Silverado, there's been a significant effort to cut weight in the new Sierra. The 2019 model loses as much as 360 pounds compared to the current truck. It uses aluminum for the doors, hood and tailgate. Steel is still used for the fenders, roof and standard cargo box. The Denali, however, gets the real surprise here. Available only on the top-tier trim, the bed box will be constructed of carbon fiber rather than steel, saving 62 pounds. Carbon fiber only replaces the steel inner panels and floor. GMC says the carbon fiber will also help scratch and corrosion resistance. SLT and Denali models also get a new MultiPro tailgate. This is unique to the Sierra and separate from the Silverado's power assist unit. A new feature that helps one get into and out of the bed using an assist handle. The tailgate step has a maximum weight capacity of 375 pounds. There multiple positions that allow customers to extend the bed, or drop the center vertically to gain easier access to the back.
