GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Texas cops pull armed suspect from burning car

A high-speed chase through Fort Worth, Texas ended in dramatic fashion earlier this month when FWPD pulled armed burglary suspects from the burning wreckage of their escape vehicle. According to NBC DFW, Fort Worth police were dispatched to Avington Way on the evening of July 16 to investigate reports of a burglary. The burglary victim told police he had arrived home to find three individuals hauling his property out of his house. When he approached them, one of the suspects pointed a handgun at him and told him to stay back. Then all three suspects climbed into a silver Dodge Avenger and sped away. FWPD officers spotted the Avenger a short time later on Sycamore School Road and, after the car refused to pull over, the chase was on. Police chased the burglary suspects through the city at speeds approaching 100 mph until the Avenger blew a red light and was t-boned by an oncoming pickup at the intersection of California Parkway and James Avenue. As the pursuing officers closed in on the disabled car, it suddenly caught fire. One suspect bailed out and ran for it, but the remaining two were trapped inside with the flames quickly mounting. Despite the spreading fire and the threat of armed suspects in the vehicle, police officers rushed to pull the men from the wreck. The driver was removed easily, but the passenger was unconscious and trapped behind a crushed passenger door. The scene was caught on the officers' body cameras as they pried the door open with their bare hands. Eventually the officers got the semi-conscious man out of the passenger seat just as the car was completely engulfed in flames. "It was pretty dramatic. We recruit people that can think on the fly, think quickly, and perform under pressure," FWPD Sergeant Marc Povero told WFAA. All three suspects are facing charges for burglary, and the driver was charged with evading arrest. GM already raising prices on 2014 Silverado and Sierra pickups

General Motors must be pretty pleased with sales of its two newest pickups, the GMC Sierra and Chevrolet Silverado, as it's announced price hikes for both models, as part of a planned price tweak.
Prices will be bumped by as much as $1,500, although weirdly, they'll be offset by as much as $1,500 in cash-back offers through the end of October. Fox Business reports that GM spokesman Jim Cain said of the price hike, "With the sell down of the '13 models nearly complete, this price adjustment was planned and is a normal part of business."
The move, as Fox is quick to point out, is an interesting one, as sales of the twin pickups struggled last month relative to the Ford F-Series, while both of GM's crosstown competitors have been aggressively undercutting Silverado and Sierra prices. The F-150 starts at $24,070 and the Ram 1500 comes in at $23,600, not counting any cash on the hood. A base Silverado, meanwhile, retails at $25,575.
