METHODS OF PAYMENT:

             Certified Check, Bank to Bank Wire Transfers or 3rd Party Financing. All funds must be in US Dollars only. Please
             be sure to have full payment and/or approved financing in place before making Final Bid. Please call us with any
             questions or additional information. Due to the difficulty of Foreign Currency/Bank Transactions, purchases from
             customers outside of the United States must pay by Wire Transfer only.

DEPOSIT DUE:
             The successful high bidder will submit a $1,000.00 NON-REFUNDABLE Partial Payment due within 2 days of the 
             close of  the auction. We accept VISA, MASTERCARD, AMERICAN EXPRESS, DISCOVER AND CERTIFIED
             CHECK for the initial Partial Payment. Partial Payments are NON-REFUNDABLE if the vehicle is NOT paid for.

BALANCE OF PAYMENT DUE:
             The buyer agrees to pay the remaining balance due within 5 days of the close of the auction. Buyer also agrees to
             pay BMW of Asheville a Dealer DOC Fee of $299.00. All financial transactions must be completed before delivery
             and/or release of the vehicle.

ADDITIONAL FEES AND TAXES:
             Out of state buyers are responsible for ALL State, County, City Taxes and Fees, as well as title/registration fees in
             the state that the vehicle will be registered in. BMW of Asheville will collect the
             proper Sales Tax and title/registration fees.

VEHICLE TITLES:
             Most vehicle titles are on hand and ready for delivery. Some vehicle titles may be held by banks and/or lenders as
             collateral for loans. In these cases, there may be a short delay in receiving the title and/or documents which can
             take 14 - 28 days from the time we pay the vehicle off. BMW of Asheville guarantees that all vehicle titles are
             Free and Clear, with no liens or liabilities on them. While we usually  have all titles in our possession at the time of
             delivery, there are occasions where we may be waiting for them to arrive. Once payment has been made, we will
             hold the titles for 10 business days or until ALL Funds have cleared. Please call if you have any questions regarding
             our titling policy.

VEHICLE SHIPPING:
             The Buyer is responsible for all shipping charges. Please contact us if you would like us to help assist in finding a
             shipping company. BMW of Asheville assumes no responsibility for any damages incurred after the vehicle has
             left our dealership. If the vehicle is to be shipped, Full Payment must be received BEFORE the vehicle is picked up 
             by you or your shipping company. We can also help arrange for pick up at any of the following local airports;
             Greenville-Spartanburg [GSP] or Asheville [AVL].

BUYER INSPECTIONS:
             Every effort has been made to accurately and fairly describe this vehicle to you. BMW of Asheville has tried to
             disclose all information known about the above vehicle to help you make an informed buying decision. Please be
             advised that used vehicles will have typical scratches and dings depending on their year and mechanical parts are
             subject to fail. BMW of Asheville welcomes a Buyers Inspection. Buyer is responsible for any inspection
             charges and fees. Buyers Inspections MUST be completed 24 Hours prior to Auction End.

WARRANTY INFORMATION/EXTENDED SERVICE CONTRACTS:
             Unless otherwise stated in the vehicles description, the above vehicle is being SOLD "AS IS". No representations or
             warranties are made by BMW of Asheville. In some cases, Manufacturer's Warranties MAY still apply, it is the
             buyers responsibilities to research this prior to bidding. Extended warranties may be available; please contact us for
             details.

NOTICE TO BIDDERS:
             BMW of Asheville reserves the right to cancel all bids and end an auction early should the vehicle no longer be
             available For Sale. It is agreed by all parties in relation to any transaction involving this vehicle that the proper venue
             for any legal proceedings will be conducted in the State of North Carolina. Miles posted in this listing may vary
             slightly due to local test driving; all vehicles are "For Sale" on our lot to the open public. These are pre-owned
             vehicles and are being sold "AS-IS" condition. Buyers should contact BMW of Asheville before hitting the "BUY
             IT NOW" button to ensure vehicle availability. Our "Internet Express Pricing" and "High Quality" vehicles attract
             multiple buyers and sell quickly. Placing your "BID" on this Auction constitutes your agreement and acceptance of
             the terms and conditions laid out within this Auction.

VEHICLE CONDITION:
             Each one of the vehicles that are on our eBay auctions are pre-owned vehicles and are not brand new. BMW of
             Asheville prides itself in finding the best vehicles to list on our auctions. Buyers should expect a certain amount of
             wear, use, and flaws, as is normal with any pre-owned vehicle. All pre- owned vehicles, including this one may have
             dings, chips and scratches. BMW of Asheville makes every effort to point out any known obvious defects that
             may not be considered or deemed normal repair. All our vehicles are sold at "Internet Value Prices", with many
             below Retail Prices. We strongly recommend that all buyers consider the purchase of an Extended Service
             Contract. Do not assume anything, please call with any additional questions you may have.

BID RETRACTIONS:
             Bid retractions are not allowed nor will be recognized within 12 hours of auction end.

SUCCESSFUL BIDDER:
             The winning bidder will be contacted via email after the auction closes and should contact BMW of Asheville
             within 24 hours to proceed with payment and delivery arrangements.

NON PAYING BIDDER:
             If your deposit is not received within 48 hours of the close of the auction; or balance is not paid in full within 5 days
             following the close of auction, BMW of Asheville reserves the right to re-list the vehicle or sell the vehicle to the
             next highest bidder or other qualified buyer. Venue for any legal action such as claims, motions, litigation,
             settlements or any legal action associated with this sale from either the buyer or seller is to take place in the
             State of North Carolina. Placing your bid on this auction constitutes your agreement and acceptance of these
             terms and conditions. You are entering into a Legal Purchase agreement that should not be taken lightly. No
             excuses of any kind will NOT be accepted by BMW of Asheville for non-payment.
