Terms of Sale:

1. Bidding, Winning and Securing your new car!:  Bay Automotive-BayCars.com reserves the right to offer our cars for sale on our retail lot as well as other internet venues. We reserve the right to cancel the auction and cancel all bids if sold elsewhere and we reserve the right to end the auction early and sell to the highest bidder at anytime during the auction. If you choose not to bid or wait until auction close we will entertain any reasonable offer to end the auction early, please don’t hesitate to contact us with an offer. The winning bidder is expected to contact us within 24 hours of auction close to confirm their winning bid. If we do not hear from you, we will assume you do not want to go through with the deal and we will offer it to the second place bidder or sell it locally. A deposit of $500 in US funds is required within 48 hours of auction close. You may either overnight us cashier’s check or certified funds or we can take a credit card deposit. Balance in full is expected within 7 days of auction close. Pick up of the vehicle is required within 14 days of auction close.

2. Deposits and Payments: As a full service retail dealer we offer a variety of financing options from the manufacturers we represent as well as local banks. These options cannot be relied upon as payment for these auctions without prior approval of the lender and the seller. If you are interested in exploring the finance options we offer, please contact us BEFORE bidding. We DO NOT accept PayPal, but will gladly accept your credit card deposit directly.

3. Taxes, Tags and Title:  We are a Florida Dealer, as well as a franchised Ford, Lincoln, Hyundai, Dodge, Chrysler, Ram, Jeep, Mitsubishi, Suzuki and Gem Car dealership. We provide complete tag and titling service as required by Florida state law.  We are required under Florida law to collect sales tax, and (if you finance your purchase) to record a lien. We will collect the sales tax of your home state and title the vehicle in your home state. BUT… there are two exceptions where you would be double taxed… and I quote from a bulletin found on the Florida Department of Revenue website “Currently, the states of Arkansas and Mississippi impose a sales tax on motor vehicles, but they DO NOT allow a credit for taxes paid to Florida. Residents of these states should be made aware that they are required to pay sales tax to Florida at the rate imposed by their home state when they purchase a vehicle in Florida and will also be required to pay tax to their home state when the vehicle is licensed in their home state.”.

Yes, we are aware that other Florida dealers may offer to sell you a car without collecting taxes. They are violating Florida law and just may be exposing you to legal liability. We will always stay within the letter of the law.

4. Fees:  All new and used car deals are charged a processing fee of $489.00. This fee is non-negotiable. Please adjust your bid accordingly.  All in state (FL) buyers are required to pay a $147.00 electronic filing fee.

5. Warranties and Guarantees:  All our eBay auctions are offered at or near wholesale pricing and are sold “AS IS” and “where is”. No warranty is implied or expressed unless specifically disclosed as part of the auction, as in the case of a vehicle that is still under factory warranty. All warranties, IF ANY, are offered by the vehicle manufacturer and NOT by Bay Automotive-BayCars.com or any of its affiliates.  Optional extended warranties are available on some of the cars we sell. PLEASE contact us for pricing and availability before deciding to bid.

6. Transportation: The winning bidder is responsible for all transportation costs and arrangements. We will assist you in finding a carrier if required or will work with the carrier of your choice. If you choose to fly in and pick up your purchase, the nearest airport to us is Beaches International Airport (airport code ECP). We will be happy to pick you up and transport you to the dealership. You can also fly into Destin or Pensacola, shuttle service from either location is approx $150.00. If you must fly into a location other than ECP, you may find renting a vehicle and returning it locally might be your most economical choice.

7. Your Peace of Mind:  We will provide a CarFax report upon request on any car we offer.   Please be advised that used vehicles will have some dings and scratches inherent for their year and mechanical parts are subject to fail. Our dealership welcomes and recommends a buyer's inspection. If you plan to have a buyers inspection, please make sure you inspect the vehicle prior to the auction ending.  Buyer is responsible for any inspection fees.

8. Worst Case Scenario:  Bay Automotive-BayCars.com is the area’s premier automotive group of dealerships. We proudly provide service to our military men and women at Tyndall and Eglin Air Force Base. We have been in business for many years and have always done business honestly and honorably. If you arrive here to pick up your car and it is anything other than the way we described it, we will refund any deposit you may have made and cancel the deal with no questions asked. We can only offer this guarantee on vehicles picked up at the dealership.

Online Bidders are entering into a legal and binding contract to purchase the vehicle described above. If you do not intend to purchase this item, DO NOT BID!

Unqualified Bidding, Auction Interference, Shill Bidding, or any form of harassment can be subject to legal prosecution.

All vehicles are sold "as-is" and without warranty. Some vehicles will have factory warranty remaining (will be stated in our description). All cars come with one master key unless otherwise stated. Vehicles come with books and/or manuals only if pictured in photo gallery and/or if stated in the advertisement.
