GM faces possible class action lawsuit over 8-speed transmission

General Motors has been hit with a class-action lawsuit from owners who allege the eight-speed automatic transmission found in several rear-wheel-drive Chevrolet, Cadillac and GMC models between the 2015 and 2019 model years has a defect that causes the vehicles to hesitate and jerk when accelerating or slowing down. The lawsuit was posted to ClassAction.org and spotted by GM Authority. Problems with GM's Hydra-Matic 8L90 and 8L45 transmissions have been well-documented on Internet forums and via complaints filed with the National Highway Traffic Safety Administration, with many reporting damage to their vehicles. The lawsuit was first filed in December in U.S. District Court for the Southern District of Florida but appears to have been transferred recently to New York. Autoblog sought comment from Theodore Leopold, the lead attorney for the plaintiffs. "These transmissions have a common defect," the complaint reads. "Drivers attempting to accelerate or decelerate their cars feel a hesitation, followed by a significant shake, shudder, jerk, clunk, or 'hard shift' when the vehicle's automatic transmission changes gears." The problem also occurs when the vehicles accelerate in a single gear, without shifting, the plaintiffs allege. "Drivers have reported that the shift is sometimes so violent, they feel as though they have been hit by another vehicle." The problem is believed to center on the transmission, torque converter or both. The complaint says it causes undue friction, causing hydraulic systems and gears to function improperly and sometimes leaves metal shavings throughout the transmission, leading to costly repairs and replacement of parts or the entire transmission. It says GM has known about the problems since shortly after it introduced the transmissions, and has issued 13 technical service bulletins, none of which have resolved the problem. GM declined to comment on the lawsuit. The plaintiffs say GM should have warned consumers about the issues and covered repairs under each vehicle's three-year/36,000-mile bumper-to-bumper warranty. They're seeking statewide classes in at least six states: California, Florida, Illinois, New York, Oklahoma and Texas.

Cadillac chief marketer admits ELR is 'a big disappointment'

During the Cadillac XT5 global launch in Dubai, Automobile interviewed Cadillac Chief Marketing Officer Uwe Ellinghaus and got the CMO to touch on just about every major issue affecting the brand and the industry. After two years on the job, having come from 15 years at BMW, Ellinghaus naturally started with the "passionate Cadillac customers" and "iconic brand" spiel, then they got into a top-down look at where America's preeminent luxury brand stands. Ellinghaus said Cadillac is in a period of transition, lately focused on smaller and more performance-oriented vehicles, which has alienated a chunk of veteran customers and left others trying to figure out what Cadillac is about. He believes that "for a few more years, the products will probably be stronger than the brand," while he does his work of conveying what the company has to offer. But the brand had to make the switch, because "Generation X and Y will make 80 percent of all actual buyers in the next five years..." On top of that, he'll be working on making sure the customer and dealership experiences are where they need to be. Speaking of dealers, Ellinghaus thinks the future will not be brick-and-mortar shops, but digital pickup-and-delivery services. "Nobody wants to go to a dealership for service and maintenance," he says. He said the ELR has been "a big disappointment," but it has taught Cadillac that converting its existing line-up to plug-in hybrids is a better way forward. However, he characterized the plug-in hybrid as "the next all-wheel drive," in that everyone's going to offer it soon, so it will be "an entry ticket into luxury automobiles rather than a differentiating aspect." The CMO thinks the CTS is suffering because of the decline in the US midsize luxury sedan market in general thanks to the SUV and crossover craze, so the brand really needs another small SUV. Woman thwarts car thieves by jumping on hood

When a pack of car thieves tried to steal a Milwaukee-area woman's car at a gas station, she didn't run for help. Oh no. She hulked out, jumped on the hood, and screamed her head off until the thief finally ran off. According to WISN, Melissa Smith was gassing up her white Subaru Outback at a BP station near Milwaukee's historic Third Ward on the afternoon of May 24. As she stood there pumping gas and minding her own business, a black Cadillac swung slowly around the front of the Subie and came to a stop just off the front left corner. As Smith turned her back to hang up the pump nozzle, a dude bailed out of the Caddy, crouched down, and snuck into the Outback's driver's seat. "I didn't see him till I saw him get into my car. Or someone was in my car, and had my, 'Oh, hell this isn't happening to me today' moment," Smith told WISN. As soon as she saw the thief in her car, Smith ran around the front then leaped on to the hood. She started yelling and pounding on the windshield as the thief tried to pull away from the pump, but he refused to stop. He tried a couple quick stops in an attempt to shake her off, but to no avail. "He looked at me, and he laughed at me, which really irritated me," Smith said. "He was laughing while I was on my car, and he was trying to throw me off, so zero remorse." Smith clung to the Subaru, shouting and pounding until the thief gave up. He abandoned ship, jumped back into the Caddy, and the group of thieves sped away. Unfortunately, when the thief bailed he left the Subie in gear with Smith still holding on for dear life. "Then I had to chase my car into the street and stop it before it hit somebody else," Smith said. Thankfully, Smith was unharmed in the incident, but the crooks got her purse, phone, wallet, and sunglasses. Milwaukee police are still looking for the suspects, who they say stole the black Caddy before trying to steal Smith's Subaru.
