Defying Trump, major automakers finalize California emissions deal

WASHINGTON — The California Air Resources Board (CARB) and major automakers on Monday confirmed they had finalized binding agreements to cut vehicle emissions in the state, defying the Trump administration's push for weaker curbs on tailpipe pollution. The agreements with carmakers Ford Motor Co, Volkswagen AG, Honda Motor Co and BMW AG were first announced in July 2019 as voluntary measures prompting anger from U.S. President Donald Trump. A month later, the Justice Department opened an antitrust probe into the agreements. The government ended the investigation without action. The Trump administration in March finalized a rollback of U.S. vehicle emissions standards to require 1.5% annual increases in efficiency through 2026. That is far weaker than the 5% annual increases in the discarded rules adopted under President Barack Obama. The 50-page California agreements, which extend through 2026, are less onerous than the standards finalized by the Obama administration but tougher than the Trump administration standards. The automakers have also agreed to electric vehicle commitments. Volvo Cars, owned by China's Geely Holdings, said in March it planned to join the automakers agreeing to the California requirements. It has also finalized its agreement. The settlement agreements say California and automakers agreed to resolve "potential legal disputes concerning the authority of CARB" and other states that have adopted California's standards. In May, a group of 23 U.S. states led by California and some major cities, challenged the Trump vehicle emissions rule. Other major automakers like General Motors Co, Fiat Chrysler Automobiles NV and Toyota Motor Corp did not join the California agreement. Those companies also sided with the Trump administration in a separate lawsuit over whether the federal government can strip California of the right to set zero emission vehicle requirements. Ford said the "final agreement will reduce emissions in our vehicles at a more stringent rate, support and incentivize the production of electrified products, and create regulatory certainty." BMW said "by setting these long-term, predictable, and achievable standards, we have the regulatory certainty that is necessary for long-term planning that will not only reduce greenhouse gas emissions but ultimately benefit consumers as well." 

Why are all US-bound BMW i3 EVs with range extenders stuck at port?

The first BMW i3 EVs have been delivered in the US, but in a quirk of the rules, none of them have been the range-extended versions. Long-time BMW electric vehicle driver Tom Moloughney discovered this fact the hard way. His i3 REx has been sitting at a New Jersey port for over a week and he's getting impatient. The problem is something Moloughney calls a "Monroney Hold." So, instead of sitting there fuming, Moloughney did a bit of research and discovered that the problem is something he calls a "Monroney Hold." He says that "the EPA certification has not been completed so BMW doesn't have a Monroney label (window sticker) to post in the window before the car leaves the port, which is required by law. The range extender option changes (shortens) the car's electric range, and also requires an official MPG rating so BMW couldn't use the same Monroney label as they did for the all electric i3." You can read more on his website, but it turns out that the story isn't so simple. For one thing, the EPA testing has been finished. Washington State representative Chad Magendaz told Moloughney that he asked the EPA for an official statement and got the following from Linc Wehrly, Director of the Light-Duty Vehicle Center Compliance Division: "EPA tested the i3 REx and provided the results of that testing to BMW on May 13th. EPA is not aware of anything that would prevent BMW from importing the vehicles since May 13th." Then there's the official word from BMW. Spokesman Dave Buchko told AutoblogGreen that: We are moving as quickly as possible to release the first BMW i3 Range-Extender models to BMW i Centers. Receipt of test data from the EPA is one step, but not the final step, in the process of receiving certification from the EPA. Rules do not permit the release of vehicles for sale until EPA labels are finalized, produced and affixed to any vehicle. Barring any unforeseen delays, we expect that to happen by the end of this week. We have never certified a vehicle like this before. We are taking every precaution to make sure that everything is done in a timely, but more importantly correct manner. In that Monroney labels cannot be produced until the EPA certification process is complete, the characterization [of a "Monroney Hold"] is not technically incorrect, but there is more to it than that, as is often true in life. BMW is ready for our inevitable EV future  

Is "rolling lithium" a thing, yet? Because BMW is trying to make this — the opposite of " rolling coal" — happen at this year's Los Angeles Auto Show. The Bavarian vehicular group is showing five all-new electric-powered concepts or production models in L.A. These include the C-Evolution, a 99-mile range scooter from BMW Motorcycles; the 150-mile range, two-door hardtop Electric Concept from Mini; and three vehicles from its advanced i sub-brand: the i3S, a sportier and more potent version of the brand's electric commuter nodule; the i Vision Dynamics four-door coupe concept, featuring a sporty four-second 0-60 time and a professed 373 mile range; and the long-promised roadster version of the i8 supercar, with just two seats, a bikini top, and an enhanced power pack providing 18 miles of range. The unveiling of these vehicles in Los Angeles makes perfect sense to us. California is one of the world's largest markets for luxury automobiles. It is also America's biggest market for electric-powered vehicles. Studies show that the state's combination of fiscal incentives, trendsetting cultural positioning, legislative requirements and massive population contributed to the purchase of half of the country's EVs and hybrids this decade. "The customers for the brand are mainly on the West and East Coasts, and the California customer especially is interested in sustainability and environmental protection," said Robert Irlinger, head of BMW's advanced i sub-brand. The bigger question revolves around BMW's larger EV strategy. Given the current global regulatory environment, with its rightful pressures on increasing efficiency and decreasing emissions to help soothe our warming planet and save all life on it, luxury automakers seem to be making a push toward developing a range of battery-powered vehicles to be available around or after the start of the next decade. It seems BMW, with its varied subsidiaries — from lightweight scooters to ultra-luxury barges — is uniquely poised to provide an array of such vehicles. "In the first stage of i back in 2013, we brought what you could call 'bookmark' cars to the market — the i3 commuter and i8 sports car — to show the range of what an electric vehicle could be," said Irlinger. "Now, we are seeing growing interest from customers to bring electrification to the heart of the brand, even to a sport sedan like our i Vision Dynamics four-door coupe.
