BMW to pay $1.6M, rehire workers in discrimination settlement

A BMW subsidiary is on the hook for $1.6 million and must rehire workers as part of a settlement for a race discrimination lawsuit with the US Equal Employment Opportunity Commission. A change in BMW Manufacturing's criminal background check policy at the Spartanburg, SC, factory disproportionately affected African American workers, according to the EEOC, and it cost many people their jobs. The automaker has since changed the policy. According to Automotive News, the suit stemmed from BMW switching logistics contractors at the plant in 2008. As a result, 645 existing workers had to submit revised criminal background checks to keep their jobs. About 100 people didn't meet the new guidelines, according to the EEOC, and they lost their jobs. Around 80 percent of those affected were African American. According to the government agency's complaint, the altered procedures only took into account the category of a crime, not factors like when it occurred or whether the infraction was a misdemeanor or felony. With the settlement accepted by US District Court, BMW must offer work to the affected employees in this case and as many as 90 African American applicants that the contractor didn't hire because of the rules. The automaker also must offer training in the proper manner for criminal background checks. While there's nothing inherently wrong with investigating workers, "when a criminal background screen results in the disproportionate exclusion of African-Americans from job opportunities, the employer must evaluate whether the policy is job related and consistent with a business necessity," P. Santa Claus might have his eight reindeer - or nine, when it's foggy - to help him deliver presents in most parts of the world, but in southern California, it looks like he's traded up from Dasher, Dancer, Prancer and company to BMW, Yamaha and Ducati. RNickeyMouse is usually the place to check out spectacular motorcycle crashes on video along LA's Mulholland Drive, but a recent video caught a trio of Santas carving up the iconic, twisty road.
The three Santas are together, riding what appears to be a BMW S1000RR, Yamaha R1 and a hard-to-tell custom bike that could be a Ducati 1098. The video, which is posted below, also catches a bonus Santa riding solo on another S1000RR. Happy Christmas to all, and to all a cool bike!

Next-generation BMW 5 Series spied in Touring trim

It almost seems as if BMW just started selling the current-generation 5 Series, yet one of our spy photographers has already spotted a next-generation prototype in Touring form. Little is known about the luxury wagon in this early stage of testing, but it is expected to weigh much less than the current car, which, in 528i Touring guise with an automatic transmission, tips the scale at over 3,800 pounds. It is also expected to have the latest in driver-assistance technology. Despite the weight savings, and judging from the photos, it looks to have proportions similar to the current car, but don't expect the makeshift headlight and taillight clusters to make it onto the production model.
The crucial question for potential Touring customers in the United States is whether BMW will do the unexpected and import it here. The company's track record indicates that it will be sold in Rest of World markets only, but we're hoping that the next 5 Series will end the Touring's U.S. hiatus (and the 5 Series Gran Turismo's reign), which began in 2003 at the end of the E39 generation.
