BMW slapped with discrimination suit by EEOC

According to a report from CNNMoney, BMW has been hit with a lawsuit from the US Equal Employment Opportunity Commission after revised criminal background check policies resulted in the dismissal of 88 contractors, 70 of whom (that's about 80 percent) were black. A total of 645 contractors were required to submit to background checks at BMW's facility in Spartanburg, South Carolina after BMW switched contract companies at its plant.
Though the 88 persons who were not rehired by the new contractor all had criminal records, that may not necessarily be a legal way to screen applicants, as the EEOC counters: "BMW's policy has no time limit with regard to convictions. The policy is a blanket exclusion without any individualized assessment of the nature and gravity of the crimes, the ages of the convictions, or the nature of the claimants' respective positions."
BMW's actions were in violation of the Civic Rights Act of 1964, according to the EEOC, because they utilized "a criminal conviction policy that disproportionately screened out African-Americans." A recent bulletin offering guidance from the EEOC on the Civil Rights Act can be found here, but the EEOC's stance on the issue has been the same for years: "Since issuing its first written policy guidance in the 1980s regarding the use of arrest and conviction records in employment decisions, the EEOC has advised employers that under certain circumstances, their use of that information to deny employment opportunities could be at odds with Title VII."

Police smash sinking BMW window with rock to save woman trapped inside

Two quick-thinking police officers in New Zealand saved a woman's life after her BMW somehow ended up in the the ocean on Tuesday afternoon. Witnesses told Stuff.co.nz the woman drove off of a rock wall surrounding a parking lot at Waitemata Harbour in Auckland, New Zealand, and into the ocean. Her BMW immediately began filling with sea water. Bystanders called police and made their own attempts to save the woman. Officers Paul Watts and Simon Russell also tried to open her car doors and smash the windows with a baton. Their failed efforts wasted precious time. The woman soon had to crawl toward the back window, the last part of her car not completely submerged in water. Officer Watts smashed the window with a rock and they were finally able to pull her to safety. Watts told The New Zealand Herald the woman was moments away from drowning. Seconds after extracting her the car sank completely into the ocean. "It was pretty close, probably 30 or 40 seconds after we managed to get the female out of the car, the car was already slipping further into the water," Watts told the Herald. Police are still investigating what caused the accident. The woman was in shock and suffered cuts and bruises. She is in stable condition at a local hospital. BMW dismisses Tesla tie-up talk

Despite recent rumors to the contrary, don't expect to see much collaboration between Tesla and BMW in the near future. Based on some rather prickly statements from the German automaker, Elon Musk might have even burnt some bridges in Bavaria with his latest proclamations. The spat stems from Musk's recent interview with German magazine Der Spiegel where he discusses future collaboration with BMW on "battery technology or charging stations" and the possibility of a battery factory in Germany. But apparently, any future tie-ups are news to the Bavarian automaker. In an interview with the German business publication Wirtschafts Woche, an unnamed spokesperson for the company claims Musk said it all for PR value and swats down most of the statements. BMW has no intention of acquiring Tesla shares, and they aren't working together on any tech. There's not much chance for future cooperation on a battery factory in Germany, either. BMW believes that the cells can just as easily be purchased from suppliers, like other auto parts. The one slight concession is that the spokesperson said that the German automaker would be willing to supply Tesla with carbon fiber. That's not an exclusive offer, though, and the company is open to negotiate such a deal with any interested automaker.
