Jaguar Land Rover seeks to block U.S. imports of Porsche, Audi, Lamborghini, VW SUVs

You wouldn’t know it was about Jags and Lambos, to judge by its rather dry name: In the Matter of Certain Vehicle Control Systems. But thatÂ’s the complaint Jaguar Land Rover Automotive Plc filed on Thursday to block U.S. imports of Porsche, Lamborghini, Audi and Volkswagen sport utility vehicles it says are using its patented Terrain Response technology without permission. Jaguar Land Rover, a British carmaker owned by IndiaÂ’s Tata Motors Ltd., said in its filing with the U.S. International Trade Commission that the technology helps negotiate a “broad range of surfaces” and is a key feature in JaguarÂ’s F-Pace and Land Rover Discovery vehicles. “JLR seeks to protect itself and its United States operations from companies that have injected infringing products into the U.S. market that incorporate, without any license from JLR, technology developed by JLR and protected by its patent,” JaguarÂ’s lawyer, Matthew Moore, said in the filing. Representatives of Volkswagen didnÂ’t immediately respond to emails seeking comment on the complaint. Jaguar wants to block imports of PorscheÂ’s Cayenne; LamborghiniÂ’s Urus; AudiÂ’s Q8, Q7, Q5, A6 Allroad and e-tron vehicles; and VWÂ’s Tiguan vehicles. It said there are plenty of other luxury midsize SUV and compact crossover vehicles to meet consumer demand if the SUVs are banned from the U.S. Still, the premium Porsche and Audi lines provide much of the profit VW is using to fund its investments in technology for electric vehicles, autonomous vehicles and further innovations. In addition to the four brands, Volkswagen Group owns other upscale nameplates, including Bentley and Bugatti. The International Trade Commission is an independent, quasi-judicial agency that investigates complaints of unfair trade practices, like patent infringement. It canÂ’t award damages but does have the power to block products from entering the U.S. Owners of patents and trade secrets like it because it can work faster than the federal district courts -- the typical investigation is completed in 15 to 18 months. But Jaguar also filed patent lawsuits against the companies in federal courts in Delaware and New Jersey, seeking cash compensation for the use of the technology. Those cases are likely to be put on hold once the trade commission launches its investigation. Funnily enough, in light of dieselgate, Volkswagen is one of the few brands (along with Volvo and Subaru) to preserve the notion that you don't need a fuel-sucking SUV to meet your life-carrying needs. And, yes, VW's history of addressing off-road desires with all-wheel-drive dates to the mid-1980s with the Quantum Syncro (a.k.a. Passat) and Golf Country – the latter, sadly, never came stateside. The latest offering toward this effort is the 2017 Volkswagen Alltrack. What's an Alltrack? It's a slightly lifted, cladded, and butched-out version of the Golf Sportwagen (yes, formerly known as a Jetta). Not to steal Alltrack's thunder, but starting in 2017 you can also get the standard Sportwagen with 4Motion AWD, which is basically the same running gear for less money. The Alltrack starts at $26,950; the 4Motion Sportwagen starts at $24,930, both with the dual-clutch automatic available at launch. Any discussion of tall wagons brings Subaru immediately to mind, both with the Outback and the Impreza-based Crosstrek. The Volkswagen Alltrack sits between the two in size at 180.2 inches long – 5 more than the Crosstrek and 9.4 inches shorter than the Outback. The 2017 Subaru Outback starts at $25,645, and VW's comparisons focus on the Outback, which is understandable given the similar starting price. A bare-bones Crosstrek starts at $22,245, but quickly gets into Golf price overlap. The Alltrack and the 4Motion Golf Sportwagen are superior daily drivers to the Subaru, whether you're doing an emergency lane change or just trying to merge onto the interstate. Meanwhile, the Crosstrek doesn't have the refinement of the VW. Can we fault Subaru though? It's set a sales record every year in a row since 2010 and is looking at about triple the sales volume of VW's Golf for 2016. So we'll stick to telling you what we think of the Alltrack and let the dealers fight for your dollars. First thing's first. Yes, you can have the Golf Sportwagen and even the Alltrack with a manual six-speed gearbox. The seven-speed DSG automatic is very good, but it's worth noting that any manual gearbox is a rarity these days, especially when we're not talking about a two-seat sports car. You will have to wait until early 2017 for that option, but it also saves you $1,100 off both models. Second, the Alltrack and 4Motion Sportwagens get identical engines. Whether manual or DSG, VW's EA888 turbocharged 1.8-liter four-cylinder is under the hood.

South Korea to file criminal charges against VW exec

South Korea has tossed out Volkswagen's recall plans and is preparing to level criminal charges over its handling of the diesel emissions catastrophe, The Wall Street Journal reports. "Recall plans the company submitted to us earlier this month were insufficient and lacked key information, and thus are unacceptable," the South Korean Ministry of Environment said in a statement obtained by the WSJ. A ministry official hinted at the possibility of criminal charges earlier this month if VW's recall plan wasn't satisfactory, the Yonhap News Agency reports, and now it looks like it will actually follow through. According to the WSJ, South Korea has already ordered VW to recall 125,000 vehicles and slapped the automaker with a $12.3 million fine – one of the many countries to do so – but if it follows through with criminal charges against the company or its employees, it'd be among the earliest to so. Other countries, including the United States, are still exploring the possibility of criminal charges. Charges would likely come against both Audi Volkswagen Korea and its managing director, Johannes Thammer. It's not clear what the actual charge would be, but the WSJ claims Thammer could be facing up to five years in prison and a fine of 30 million won (around $24,700 at today's rates). For its part, VW officials in South Korea maintains that it is "doing its utmost to resolve the emissions issue" and that it plans to "offer further explanation" to authorities regarding its proposal for an emissions and fuel mileage fix in that country.
