German judge 'inclined to dismiss' hedge fund lawsuit against Porsche

Last year, around two dozen investors, including hedge funds, leveled a 1.4 billion euro ($1.95 billion at the time) lawsuit against Porsche in connection with the automaker's attempted takeover of Volkswagen in 2008. The Stuttgart Regional Court dismissed the case. Around 19 of those plaintiffs are heading back to court to appeal the ruling and still hope to get 1.2 billion euros ($1.4 billion). However, according to one German judge, the chances for success aren't any better this time around. "On balance it's our view that we consider the lawsuit, or the appeal, to be unpromising for several reasons," Gerhard Ruf, a judge in Stuttgart, said to Reuters. "We are inclined to dismiss the case." The court's ruling on the appeal will be announced on March 26. The investors' case hinges on Porsche's strategy surrounding the botched takeover. The sports car maker said that it wasn't trying to control VW, when in fact it was. These hedge funds had bet against Volkswagen stock, but the share price surged when Porsche's plan inevitably came to light. Investors have sued the sports car company multiple times since then in attempts to recoup billions of dollars. However, none of the lawsuits have been successful, whether attempted in the US or Germany. Former Porsche CEO Wendelin Wiedeking and and CFO Holger Haerter might still stand trial for the alleged stock manipulation, though. Volkswagen unveils sportier Passat Performance Concept ahead of Detroit debut

Ahead of its official unveiling at next week's Detroit Auto Show, Volkswagen has released some preliminary details and images of its Passat Performance Concept - a car that, as its name suggests, adds a little more spice to the automaker's midsize sedan formula. VW makes no mention of any production intent for this road-ready-looking sedan, simply stating that the Performance Concept is a way to "explore this practical four-door's sportier side."
It certainly doesn't look too sporty, the only visual upgrades being larger 19-inch wheels, dual exhaust, bi-xenon headlamps with VW's Advanced Front Lighting system, LED taillmaps and carbon-look mirror caps. Inside, there are carbon interior accents and two-tone leather upholstery. But no matter, the real upgrades for this mightier Passat are found below the sheetmetal.
Powering the Performance Concept is a 1.8-liter turbocharged four-cylinder engine, churning out 250 horsepower and sending its grunt to the ground via a six-speed automatic transmission. For reference, that's 80 more horsepower than the Passat's base 2.5-liter inline-five, but 20 horsepower less than the potent 3.6-liter VR6. As for other performance upgrades, Volkswagen has fitted the car with a lowered sport suspension and revamped electronic steering, which should indeed add a bit more dynamic feedback to the already nice-driving sedan.

Earlier we reported on a recall issued for the 2015 VW Jetta regarding a problem with the headlights, and now Volkswagen and the National Highway Traffic Safety Administration have issued another recall for a separate issue affecting not only the Jetta, but several other models as well. The issue revolves around a sealing cap in the fuel rail, which could leak fuel into the engine compartment and potentially cause a fire. The problem affects an estimated 37,979 vehicles in the United States, including the 2014-15 Jetta (manufactured between March 28 and November 24, 2014), the 2014-15 Passat (April 7 to November 18), the 2015 Golf and GTI (July 1 to November 20) and the 2014-15 Beetle and Beetle Convertible (March 31 to November 27). That covers pretty much the entire range offered by Volkswagen of America, short of the Tiguan and Touareg crossovers (and the discontinued Eos convertible). Considering, though, that VW routinely sells around 30,000 vehicles in the US each month, the small number of vehicles being recalled (relative to the quantity out there) tells you this recall really only affects a specific cross-section of models. Owners of the affected vehicles can expect to be contacted by their dealers to have the fuel rails replaced.
