U.S. and Toyota Reach Settlement Over Safety Problems Disclosure

The U.S. has reached a $1.2 billion settlement with Toyota Motor Corp., concluding a four-year criminal investigation into the Japanese automaker's disclosure of safety problems, according to a person close to the investigation. Attorney General Eric Holder, Transportation Secretary Anthony Foxx and U.S. Attorney for the Southern District of New York, Preet Bharara, were announcing the settlement Wednesday morning, said the official, who spoke on condition of anonymity because the official was not authorized to discuss the settlement on the record before the announcement. The criminal investigation focused on whether Toyota was forthright in reporting problems related to unintended acceleration troubles. Starting in 2009, Toyota issued massive recalls, mostly in the U.S., totaling more than 10 million vehicles for various problems including faulty brakes, gas pedals and floor mats. From 2010 through 2012, Toyota Motor Corp. paid fines totaling more than $66 million for delays in reporting unintended acceleration problems. The National Highway Traffic Safety Administration never found defects in electronics or software in Toyota cars, which had been targeted as a possible cause. The settlement continues a string of bad publicity for Toyota, which before the unintended acceleration cases had a bulletproof image of reliability. Since the cases surfaced, the company's brand image has been damaged and it has lost U.S. market share as competition has intensified. Last year, Toyota agreed to pay more than $1 billion to resolve hundreds of lawsuits claiming that owners of its cars suffered economic losses because of the recalls. But that settlement did not include wrongful death and injury lawsuits that have been consolidated in California state and federal courts. In December, Toyota filed court papers after a four-year legal battle saying that it's in settlement talks on nearly 400 U.S. lawsuits, but other cases aren't included in the talks.

Mazda's new paint system has won the Prime Minister's Award in the category of Manufacturing and Production Process at the 6th Monodzukuri Nippon Grand Award ceremony. Mazda's Aqua-tech paint system significantly reduces emissions of volatile organic compounds (VOCs) and CO2. The Aqua-tech system uses a water-based color basecoat and a urethane clear coat to reduce VOC emissions by 57 percent. It consolidates the painting process and reduces energy in paint-booth air-conditioning and flash-off processes to reduce energy consumption. The Toyota Mirai has received a 2015 Environmental Award from Austrian automobile club ARBO. The hydrogen fuel cell car took the prize in the category of Current Innovative Environmental Technologies. "At Toyota, we believe that various technologies will co-exist, ranging from EVs to hybrids to the most innovative of all, the fuel cell car," says Gerald Killmann, Vice President R&D of Toyota Motor Europe, in a comment thanking ARBO. Judge halts Toyota unintended acceleration cases, triggers time for settlement negotiations

So far, the lawsuits brought forth against Toyota for unintended acceleration have gone both ways: the automaker was found not at fault in a 2009 California crash and liable for a 2007 crash in Oklahoma. Both cases involved a Camry and resulted in fatalities. With a big chunk of these UA cases (around 200) set to his the docket of US District Judge James V. Selna in Santa Ana, California, Bloomberg is reporting that the judge has halted the lawsuits until March after Toyota and its lawyers have had extra time to try and settle the cases.
According to the article, Toyota is looking to take care of the cases out of court with an "intensive settlement process." Having already paid out $1.6 billion in "economic loss" suits, this latest settlement process is aimed at the wrongful death and personal injury cases allegedly associated with unintended acceleration. A hearing for the settlements will be held on January 14 with conferences on the matter commencing in February. There is no word as to when lawsuits may start back up if settlements can't be agreed upon.
