Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

Toyota takes i-Road tests to the streets of Tokyo

OK, here's where we think those road tests will start to get a little scary. Those super-narrow all-electric three-wheeled Toyota i-Road vehicles may have looked great sashaying through the towns of the French Riviera. But now? They're being tested in Tokyo. Hoo boy. The Japanese automaker says it'll start testing the i-Roads in the country's largest city on March 24 and will do so through early June. And while there will be some industry experts among the 20 participants, there will also be some regular folks who we hope won't find out the hard way how well those 660-pound, one-yard-wide vehicles perform in crash tests. In the meantime, we'll cross our fingers. The cool thing is that the i-Road now comes in five colors: blue, green, white, yellow and what looks like a magenta-fuchsia-type hue. Earlier this month, Toyota said it started testing the vehicles in Toyota City, Japan, as part of a broader program called "Ha:mo" where people link shared vehicles with public transportation systems (it stands for "Harmonious Mobility Network"). The three-wheeler was unveiled at the Geneva Motor Show early last year before getting the star treatment in a French Riviera-locale video. Toyota's Lentz says fuel cells are the future, not EVs

Toyota is not bullish on EVs. That comes from the company's North American CEO, Jim Lentz, who said the company will focus not on electrification, but on continued hybridization with a long-term focus on hydrogen fuel cells.
Lentz questioned the long-range ability of EVs, saying that Toyota feels "there are better alternatives, such as hybrids and plug-in hybrids, and tomorrow with fuel cells." Lentz spoke about Toyota's focus on hydrogen following Forbes Brainstorm Green conference and barely a week after a battery deal between Tesla and Toyota ended, according to Automotive News.
That deal provided for 2,500 battery packs for the Rav4 EV. While valuable to Toyota, the deal "was never about open-ended volume," Lentz said. "It was time to either continue or stop. My personal feeling was that I would rather invest my dollars in fuel cell development than in another 2,500 EVs."
