Toyota settles first wrongful death suit related to unintended acceleration

Toyota's sales seem to have rebounded from the unintended acceleration issues from 2009 and 2010, but the automaker is far from done dealing with this situation. Following a settlement worth up to $1.4 billion for economic loss to affected vehicle owners, Toyota has settled rather than going to trial in a wrongful death lawsuit stemming from an accident in Utah in 2010 that left two passengers dead. This isn't the first case in which Toyota has settled, but it was the first among a consolidated group of cases being held in Santa Ana, CA.
According to The Detroit News, this case was scheduled to take place next month, and it was for a November 2010 incident in which Paul Van Alfen and Charlene James Lloyd were killed in a Camry when, based on findings by the Utah Highway Patrol, the accelerator got stuck causing the car to speed out of control and hit a wall; the terms of the settlement were not announced.
The article says that while Toyota will settle on some cases, it doesn't plan on settling on all of them as it still wants to be able to "defend [its] product at trial." This will probably be the case in suits claiming that software for the drive-by-wire accelerator was the cause of an accident in a Toyota or Lexus vehicle. The question of whether or not the electronic accelerator played any role in this problem has been a hot-button topic since the beginning. Toyota has issued recalls in the past to attempt to prevent unintended acceleration caused by trapped floor mats and faulty accelerator pedals, but it also says driver error was to blame in some instances.

Audi has made environmental improvements to the its TT while boosting performance. The new TT sees an 11-percent reduction in emissions, and up to 14 percent more power. Audi says that each TT will save around 5.5 metric tons of greenhouse gas emissions over its lifecycle. Speaking of greening up Audis, Al Swackhammer of Washington converted his 1960 Audi DKW 1000S to run on electric power. Swackhammer first fell in love with the Audi Ur-Quattro, became an enthusiast of Audi and Volkswagen cars, and has owned nothing else ever since. With his DKW, he combined his passion for the classic car with his responsibility to the environment. "I am pleased that I did this project," says the happy owner, "and I enjoy driving it very dearly." Meet the man and his beloved electric Audi DKW in the video below. Toyota has chosen a sustainable design firm, Corgan, as the lead architect for its new North American headquarters. The new campus will be built in Plano, TX, and will be the workplace of about 4,000 Toyota employees. Corgan, who has already done 47 LEED certified projects, is already designing a temporary office for the site while it finishes the project. Toyota expects to begin working from the site in late 2016 or early 2017. Learn more in the press release below. In July, all new electrical generating capacity in the US came from renewable sources. The Federal Energy Regulatory Commission's Office of Energy Projects' newest "Energy Infrastructure Update" report says new electric generation put into service last month came from wind (379 megawatts), solar (21 megawatts) and hydro (5 megawatts). So far this year, 53 percent of new energy generation capacity has come from various renewable sources, and none from coal or nuclear. Currently, renewable energy accounts for 16.3 percent of the US electric generation capacity, providing about 14 percent of actual electricity. Unintended acceleration settlement hits Toyota's Q4 bottom line

Depending on how you want to look at things, the US Attorney's Office $1.2-billion dollar settlement with Toyota in March over its unintended acceleration recall was either a big blow to the company or completely inconsequential. From January to March, net income fell five percent to 297 billion yen ($2.89 billion), compared to 313.9 billion yen ($3.05 billion) a year ago. However, the automaker still posted record full-year profits worldwide.
Operating profit also fell in the US by 9 percent to $498.1 million for the quarter, but sales were up by 6 percent to 581,261 vehicles. According to Automotive News, global revenue was still up from January to March by about 13 percent and vehicle sales were up 6 percent to 2.58 million units.
However, the payment to the feds did little to hold the company back last year. For the fiscal year ending March 31, 2014, Toyota had net income of 1.82 trillion yen ($17.7 billion), compared to 962.1 billion yen ($9.5 billion) in the last fiscal year. Total vehicle sales were also up.
