Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

Toyota amalgamates motorsports divisions under Gazoo Racing

Toyota has more racing divisions than we could wave a checkered flag at, with the company's various motorsport activities all coordinated by different operations. But the Japanese industrial giant is now bringing most (if not all) of them under one roof. From here on in, any racing that was done under the Toyota Racing, Lexus Racing or Gazoo Racing banners will now be united under the latter. That includes the LFAs it races around the Nurburgring, the TS040 Hybrid it fields at Le Mans and in the World Endurance Championship, the Yaris it will soon throw at the World Rally Championship, the Lexus racers that compete in the Super GT championship back in Japan... the works. The move does not appear to affect Toyota Racing Development, the automaker's American arm that handles its NASCAR racing activities, but from here on out, any Toyota or Lexus you see racing on most anything but a speedway will be competing under Gazoo Racing. The move appears to be more than symbolic and semantic, putting its racing vehicle development, technical support and marketing activities in the hands of the new Motor Sports Group. In announcing the consolidation, Toyota highlights in particular the benefit its various racing programs bring to its talent pool, if not the direct effect they have on the company's vehicles themselves. Of those, GAZOO Racing in particular was created to expand the role of promoting motorsports beyond that of traditional automakers, and carry out grassroots activities aimed at creating new and ever-growing generations of car enthusiasts. Suzuki will road-test EVs in India, start production with Toyota in 2020

NEW DELHI — Japan's Suzuki Motor Corp will start testing prototypes of electric vehicles in India by October, its chairman said on Friday. "We will start road-running tests using a fleet of 50 EV prototype vehicles in India from next month in order to develop safe and easy-to-use EVs for Indian customers," Osamu Suzuki said at the Global Mobility Summit at New Delhi. The company would then launch EVs in India around 2020 in cooperation with Toyota, he added. However, Suzuki said that for EVs to become popular in India, there had to be well-developed charging infrastructure. "In this regard, we look forward to proactive leadership from the Indian government," he said. The government of Prime Minister Narendra Modi has a plan to electrify all new vehicles by 2030, a target many experts call ambitious. EVs are expensive due to the high cost of batteries which are still not manufactured in India, and carmakers say a lack of charging stations could make the proposition unviable. Suzuki, parent of India's top-selling automaker, Maruti Suzuki, would start production of lithium-ion batteries for automobiles at its plant in western India from 2020, Suzuki said. India is one of the world's fastest-growing car markets, but EV sales are negligible compared with millions of petrol and diesel cars sold every year. Suzuki said to meet India's environmental challenges, the government would have to look at hybrid and CNG (compressed natural gas) vehicles also.Related Video:
