Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

Scientists at Toyota have developed battery technology that allows for higher energy density. Using material from hydrogen storage, researchers at the Toyota Research Institute of North America (TRINA) in beautiful Ann Arbor, Michigan have created an electrolyte that works well with a magnesium metal anode. Besides improving energy density for smaller, more powerful batteries, magnesium is also more stable than lithium, making it a safer alternative. Rather than guarding their secret, Toyota is sharing details of this breakthrough in order to advance the technology in hopes of an earlier mass deployment of magnesium batteries. The automaker builds two diesel engines – a 1.6-liter and a 2.0-liter – at its plant in Tremery, France at a rate of 7,000 engines a day. BlueHDi technology uses three different emissions control mechanisms to filter pollutants out of diesel exhaust, including an oxygen catalyst, an additive filter to remove particulate matter, and a Selective Catalytic Reduction system to reduce NOx. Lexus GX, Toyota Land Cruiser Prado facelifts leaked

The Lexus GX and the Toyota Land Cruiser Prado, which isn't sold in the US, have gone without visual updates since the current generation was launched in 2009. But what appear to be patent filing sketches and pictures of the sibling sports utility vehicles' mid-cycle updates have been leaked on a Russian Land Cruiser Club forum.
Major changes to the GX's front end will be made to incorporate Lexus' signature grille. Gone are the awkwardly shaped headlamps and the soft-looking triple-slat grille. The sketch shows the Lexus with a new bumper, lower-profile headlights and a more aggressive, angular grille with one more slat and a gaping lower air-intake opening. The vehicle's profile looks unchanged, but the rear bumper will be reshaped slightly to fit new, better-integrated horizontal reflectors.
The Toyota gets a handful of styling updates as well, including a new front bumper with higher-profile headlamps that look a bit out of place to us. The Prado's profile also looks unchanged, but the rear end gets restyled taillights and a reshaped license-plate enclosure.
