Tesla Motors appeals sales ban in New Jersey

Resistance to the way Tesla Motors sells its cars - directly to the consumer, with no negotiating and no dealer middleman - comes mostly from dealership organizations around the country. It's also illegal in some states, thanks to laws ushered into place with help from dealers. The reaction to Tesla's new style of business is led by what Steve Blank calls, "rent seekers" or "landlords of the status-quo." Tesla itself isn't into that sort of name-calling, but it will take to the courts when necessary. Case in point, New Jersey, where the legislature voted in mid-March to stop Tesla stores from selling cars starting April 1. This week, the New Jersey Motor Vehicle Commission (MVC) extended a deadline until April 15, a move that could save the EV automaker's future in the state. Tesla has now filed with the state Superior Court asking that the ruling be appealed. Tesla says that the MVC is taking its orders from the state dealers association, the New Jersey Coalition of Automotive Retailers. Tesla also made an argument against the traditional gasoline vehicle dealers that we've heard before. Here is some of the text of the appeal: Franchise dealers have an inherent conflict of interest in selling electric vehicles. In order to do so effectively, they would need to enthusiastically tout the reasons why electric vehicles are superior to gasoline vehicles. This is not something that they are going to do since gasoline vehicles represent virtually all of their revenue. Dealers also depend on quick, high volume sales - incentivized by substantial sales commissions - in large, out-of-the-way facilities that contain large inventories of new and used cars. By contrast, Tesla sells its cars in relatively small showrooms, often located in shopping malls (like the two stores in New Jersey) that invite people unfamiliar with electric cars to drop in. Tesla Model S sells 6,900 units in Q4, eyes top of the charts

Tesla Motors sold roughly 6,900 of its battery-electric Model S sedans during the last three months of 2013, making it the country's best-selling plug-in vehicle during the fourth quarter. The California-based automaker beat independent sales estimates by about 20 percent and increased its quarterly sales rate from the third quarter by about 25 percent. More notably, Tesla's fourth-quarter sales beat those of Nissan Leaf EV (6,534 units), and the Chevrolet Volt extended-range plug in (6,334). For the year, Tesla sold about 22,300 vehicles, putting it just behind the Volt's 23,094 vehicles and the Leaf's 22,610. Heck, Tesla sold more green cars last year than Honda, which moved about 20,600 battery-electric, hybrid and plug-in vehicles, combined. Investors were certainly happy with the news. Shares of TSLA were up around 16 percent in Tuesday trading, closing at $161.27. The news release was conveniently timed to change the story from the issues Tesla has regarding its wall chargers and what's believed to be their potential role in a garage fire. With almost 6,900 vehicles sold and delivered, Tesla exceeded prior guidance by approximately 20%. A higher than expected number of cars was manufactured as a result of an excellent effort by the Tesla production team and key suppliers, particularly Panasonic. The two key drivers of demand were the superlative safety record of the Model S and great performance under extremely cold conditions. Is Tesla building a new skunkworks facility in Lathrop, California?

Tesla Motors has a secret. The California automaker has leased, and is now renovating, a 431,000-square foot former Daimler-Chrysler distribution facility in Lathrop, CA, but is not saying exactly what it will be using the space for. At least, not yet. About an hour's drive east from its Fremont, CA factory, the property is located just off the north-to-south Interstate 5 (I-5) and has extra acreage to expand the building by another 124,980 sq-ft, if needed. Designed to handle a lot of shipping in and out, one side of the structure is gifted with 32 truck docking bays. With no official word on the type of activities that are planned for the facility, it is only natural that we would want to speculate a bit. There is one clue out there that can aid our hypothesizing. The job section of the company's website lists a number of openings that would indicate manufacturing of some sort is intended for the space. We'll go ahead and rule out serial vehicle production, since the Fremont space still has ample room for that activity to handle the upcoming Model X and the more affordable future vehicle. It's far too small to be a battery gigafactory, so could it be instead a kilofactory ? Probably not. Of course, it could just be a new site for producing components for the Fremont production lines, but that doesn't sound nearly as exciting. It also doesn't seem to be worthy of secrecy. The coolest – though not necessarily most accurate – thing we can come up with is a skunkworks. A secret lair where new concepts are conceived and developed away from the prying eyes of the public. Yeah, we'll go with that. When we contacted Tesla for clues about the facility's purpose we got a boilerplate response, though interestingly, they might have thrown us another mysterious bone in the process. And we quote, "Tesla is continuing to invest and create jobs in California as part of our ongoing infrastructure expansion. In the last two months, we have signed leases for more than 625,000 square feet of Californian real estate, independent of sales and service centers. These recent investments reinforce our commitment to California and will help us continue to bring compelling electric vehicles to market at affordable prices." With a 194,00-sq ft discrepancy between the known Lathrop acquisition and the numbers given by the automaker, it seems that may be yet another decent-sized unknown building in the mix.
