Subaru suing CA dealership for alleged false customer surveys

Whenever you buy a new car from a dealer these days or sometimes even go in for service, you can expect to fill out a customer satisfaction survey at some point down the road. The responses are actually quite important to showrooms because automakers require the businesses to keep things at a certain level or face penalties. However, a Subaru dealer allegedly found a way to game that system, at least briefly, and now the Subaru of America has filed a lawsuit in US District Court for breach of contract. South Coast Subaru in Costa Mesa, CA, reportedly falsified 224 customer satisfaction questionnaires in 2014, according to Automotive News. The scheme wasn't that hard to figure out, though. All of the faked surveys were allegedly submitted through the IP address of an Acura showroom managed by the same dealer. Under normal circumstances when someone buys a Subaru, the dealer is supposed to collect the customer's email address and submit it to the automaker. However, South Coast allegedly presented false addresses, and then managers had employees fill the forms out during lunch. Subaru claimed in the suit that by doing this the dealer harmed the company's product reputation and its goodwill among customers. "Defendants prevented Subaru from discovering the actual customer satisfaction level of Subaru retail customers at South Coast Subaru by providing sham customer surveys to [Subaru]," the complaint said, according to Automotive News. Power Doesn't Come Cheap
When Subaru first offered a turbocharged Forester XT model to US customers for the 2004 model year, the shoe-shaped second-gen model fell into a ready-made competitive set of small, V6-powered crossovers and SUVs. The XT might have been more of a raucous shopping-trip companion than, say, a Ford Escape V6, but the basics of the cars offered a clear differentiation from the naturally aspirated, four-cylinder models found just a bit downmarket. Here in 2013, the V6 breed of crossover in this size class is all but extinct, and turbocharged four-cylinders with the power to compete with the XT are not thick on the ground.
In many ways, the comparative analysis gets most interesting when you start looking around for CUVs to match up with the all-boxes-ticked Forester XT Touring that we had as a tester for a recent week. The top of the line Touring trim means that the Forester comes with features like 10-way power seats, leather, navigation, a Harmon Kardon sound system with HD radio, Bluetooth and more. In fact, our Forester also had the only option package available on the XT Touring; one that included keyless access, HID headlights and Subaru's EyeSight system (adaptive cruise, lane departure warning and pre-collision braking).

Subaru Forester, Legacy and Outback earn IIHS Top Safety Pick+ ratings

The Insurance Institute for Highway Safety announced its more rigorous standards for the Top Safety Pick+ crash test rating back in September, and has recently called out some new models that have attained this highest rating. Last year, the TSP+ category was created for vehicles passing the then-new small overlap crash test; this year the top award has been amended to include crash prevention technology.
Thanks to its EyeSight technology, the Subaru Legacy, Outback and Forester are among just 22 vehicles to have been named a 2014 TSP+ by the IIHS. Without this technology, all three vehicles - and the Impreza and XV Crosstrek - were still named a Top Safety Pick (without the +).
To test the crash prevention technology, the IIHS uses two tests (one at 12 miles per hour and one at 25 mph) to see how well the systems do to lessen the severity of an impact. or prevent an impact altogether. Vehicles are then given a rating from Superior (best), Advanced or Basic, and cars that do not offer forward collision warning or auto braking are not given a rating in this category. To be named a TSP+, a car must achieve at least a Basic score for crash prevention, but all three Subaru models earned a perfect score to receive a Superior rating.
