Subaru suing CA dealership for alleged false customer surveys
Sat, Feb 14 2015Whenever you buy a new car from a dealer these days or sometimes even go in for service, you can expect to fill out a customer satisfaction survey at some point down the road. The responses are actually quite important to showrooms because automakers require the businesses to keep things at a certain level or face penalties. However, a Subaru dealer allegedly found a way to game that system, at least briefly, and now the Subaru of America has filed a lawsuit in US District Court for breach of contract. South Coast Subaru in Costa Mesa, CA, reportedly falsified 224 customer satisfaction questionnaires in 2014, according to Automotive News. The scheme wasn't that hard to figure out, though. All of the faked surveys were allegedly submitted through the IP address of an Acura showroom managed by the same dealer. Under normal circumstances when someone buys a Subaru, the dealer is supposed to collect the customer's email address and submit it to the automaker. However, South Coast allegedly presented false addresses, and then managers had employees fill the forms out during lunch. Subaru claimed in the suit that by doing this the dealer harmed the company's product reputation and its goodwill among customers. "Defendants prevented Subaru from discovering the actual customer satisfaction level of Subaru retail customers at South Coast Subaru by providing sham customer surveys to [Subaru]," the complaint said, according to Automotive News. Subaru breaks all-time sales record well before year end

That's great, but even more impressive is that this is the company's seventh successive record-breaking year and its eighth year of overall growth. Through November, the bulk of Subaru's sales came from its strong crossover lineup – the Forester, Outback, and XV Crosstrek accounted for 350,000 of the company's 513,000-plus sales. As for the Impreza, Legacy, and high-performance WRX/STI, there were also "significant year-to-date increases," according the company's official release. Sales for 2015 have now surpassed the previous annual sales record of 513,693 vehicles set in 2014 and mark the company's eighth year of sales growth and seventh successive sales record. Sales in 2015 have been driven by the Forester, Outback and Crosstrek carlines. Combined, the three crossover vehicles now retail over 350,000 units per year. When Subaru first offered a turbocharged Forester XT model to US customers for the 2004 model year, the shoe-shaped second-gen model fell into a ready-made competitive set of small, V6-powered crossovers and SUVs. The XT might have been more of a raucous shopping-trip companion than, say, a Ford Escape V6, but the basics of the cars offered a clear differentiation from the naturally aspirated, four-cylinder models found just a bit downmarket. Here in 2013, the V6 breed of crossover in this size class is all but extinct, and turbocharged four-cylinders with the power to compete with the XT are not thick on the ground.
In many ways, the comparative analysis gets most interesting when you start looking around for CUVs to match up with the all-boxes-ticked Forester XT Touring that we had as a tester for a recent week. The top of the line Touring trim means that the Forester comes with features like 10-way power seats, leather, navigation, a Harmon Kardon sound system with HD radio, Bluetooth and more. In fact, our Forester also had the only option package available on the XT Touring; one that included keyless access, HID headlights and Subaru's EyeSight system (adaptive cruise, lane departure warning and pre-collision braking).
