Ram and Jeep diesel emissions allegations spur class action lawsuits

This shouldn't come as a surprise. Last week, the EPA issued a notice of violation to FCA after it determined that Jeep and Ram installed eight undisclosed auxiliary emissions control devices on diesel vehicles. Since then US law firm Heninger Garrison Davis, LLC and Canadian firm Sotos LLP have launched class action suits on behalf of owners. These latest lawsuits are unrelated to a previous class action suit brought against FCA and Cummins over NOx emissions in 2007 to 2012 Ram models. The violation notice – and the subsequent lawsuits – covers 2014 to 2016 Jeep Grand Cherokee and Ram 1500 models equipped with the 3.0-liter turbodiesel V6, a total of about 104,000 vehicles in the US. The EPA says that while the emissions control devices aren't necessarily illegal, installing them without disclosing them to the EPA is, as they produce more emissions in real world use than in testing. Skirting certification in this way might be a violation of the Clean Air Act. FCA could see fines of up to $45,000 per vehicle, depending on the outcome of the EPA investigation. FCA denies that these are cheat devices, and has proposed software updates to bring the vehicles into compliance. As for the lawsuits, Heninger Garrison Davis says that "Fiat Chrysler marketed those vehicles as environmentally friendly with enhanced fuel efficiency, better performance, and lower emissions. Although the diesel vehicles were successfully marketed as 'clean,' their environmentally-friendly representations were deceptive to consumers." The suit seeks an undisclosed amount of compensation for owners of these vehicles. In Canada, Sotos LLP is seeking $250 million in damages on behalf of owners. This suit, filed in the Ontario Superior Court of Justice, also claims deception on the part of FCA, "resulting in losses and damage" to owners. These are similar claims to group actions against Volkswagen with regard to its diesel emissions cheating scandal. While VW is fixing or buying back many of the affected vehicles, the company is defending itself against some suits on behalf of owners, saying it expects " no decline in the residual values of the affected vehicles as a result of this issue." Don't be surprised if FCA mounts a similar defense.

1.8 million Ram trucks recalled to fix shifter problem

Fiat Chrysler is recalling 1.8 million mostly heavy-duty Ram pickups to fix a part that could allow the truck to shift out of park and roll without depressing the brake pedal, a problem the automaker knows to be potentially related to seven injuries and a "small number" of accidents. The company says tests revealed that the interlock, which is supposed to keep the transmission from shifting out of park without the driver's foot on the brake and without a key in the ignition, may malfunction if subjected to high temperatures for long periods. The recall is limited to vehicles equipped with shifters mounted on the steering columns; those with rotary-dial shifters or floor-mounted shifters aren't affected, and model-year 2017 trucks built after Dec. 31, 2016, are excluded. Trucks covered by the recall are certain 2010-2017 Ram 2500 and 3500 pickups; 2011-2017 Ram 3500, 4500 and 5500 chassis cabs; and 2016 and 2017 Ram 3500 chassis cabs of less than 10,000 pounds gross vehicle weight. Certain 2009 through 2017 Ram 1500 pickups are also included in the recall. Most of the affected trucks are in the U.S., with the rest in Canada and Mexico, plus about 15,000 outside of the North American Free Trade zone. Ram recalls 30k trucks over faulty turn signals

According to the National Highway Traffic Safety Administration, Chrysler is issuing a recall of 30,197 pickup trucks in the United States, all from the 2013 model year. The affected vehicles are the Ram 1500, 2500 and 3500, all of which were built between September 9, 2012 and March 5, 2013.
The problem affects models equipped with "optional premium taillamps," and according to NHTSA, the turn signal indicator "may not flash at a double rate to give a notification to the driver of a turn signal malfunction." The report states that if a driver is unaware of a problem with the turn signals and continues to use them as normal, other vehicles on the road may not be alerted that the vehicle is turning, which increases the risk of a crash.
Other recall woes have affected the Ram line recently. In April, we reported that Ram 1500 models were being recalled due to an improper adjustment of the parking brake cable, and several thousand Heavy Duty models were being called in for engine covers that do not have as much heat resistance as they're supposed to.
