Roger Rodas' Widow Suing Porsche Over Carrera GT Crash

Investigations undertaken by local law enforcement may have vindicated Porsche from any wrongdoing in the crash that killed actor Paul Walker and racing driver Roger Rodas last year, but the latter's widow is apparently not convinced. According to emerging reports, Kristine Rodas has filed a lawsuit seeking unspecified damages from Porsche Cars North America. In her suit filed with the Los Angeles Superior Court, Rodas' attorney Mark Geragos reportedly disputes the findings of the Los Angeles County Sheriff's Department, which asserted that the vehicle was traveling at an unsafe speed of 90 miles per hour on city streets, identifying the speed as the cause of the accident. Instead the lawsuit claims that the vehicle was only going 55 mph and that the cause of the crash was improper equipment – namely a faulty right rear suspension and the lack of a crash cage and proper fuel tank. "The Carrera GT was unsafe for its intended use by reason of defects in its manufacture, design, testing, component and constituents, so that it would not safely serve its purpose," according to the specifics of the suit obtained by the Los Angeles Times. When reached for comment, Porsche Cars North America spokesman Nick Twork told Autoblog: We are very sorry for the Rodas and Walker family's loss. The crash was the subject of a detailed investigation by the proper authorities (L.A. County Sheriff and California Highway Patrol), and their investigation disproves the allegations in the lawsuit. The investigation found that driving at a high speed in a negligent manner caused the crash and concluded that there was no mechanical defect. The Carrera GT is known as a difficult car to drive. As the LA Times report points out, Jay Leno spun one at Talladega in 2005, and the following year, Porsche paid part of a multi-million-dollar settlement after two were killed on a track when their Carrera GT struck a slower-moving Ferrari. The Rodas lawsuit could very well point to that previous suit from San Diego Superior Court. Whether the court in LA will hand down a similar ruling remains to be seen.

This time we're strapped into a black racing bucket of a filthy Porsche 911 rally car, one that led Harris to effuse, "I don't think I've driven a more exciting car this year, hypercars included." The thrills come courtesy of a 997-series Cup Car that's been reworked by Tuthill Porsche to run in the RGT-class rally series that will piggyback on five World Rally Championship and European Rally Championship races this year. It's not quite the Rothmans Dakar monster, but the RGT series gives privateers an affordable way into rallying with cars that look different and are different from one another. This one kept its 3.8-liter, 444-horsepower 997 Cup engine, but the 39-milllimeter restrictor drops that to about 350 hp. Beyond that are a new rollcage, gear ratios, suspension, fuel tank, underfloor protection and just about everything else. Said the man who built it, it cost "a lot, and it's still costing." But Harris says even though you "have to have your wits about you," it's a hoot to drive. And this is one of the few times you'll hear the phrase "What a tool!" used as a compliment. Jaguar Land Rover seeks to block U.S. imports of Porsche, Audi, Lamborghini, VW SUVs

You wouldn’t know it was about Jags and Lambos, to judge by its rather dry name: In the Matter of Certain Vehicle Control Systems. But thatÂ’s the complaint Jaguar Land Rover Automotive Plc filed on Thursday to block U.S. imports of Porsche, Lamborghini, Audi and Volkswagen sport utility vehicles it says are using its patented Terrain Response technology without permission. Jaguar Land Rover, a British carmaker owned by IndiaÂ’s Tata Motors Ltd., said in its filing with the U.S. International Trade Commission that the technology helps negotiate a “broad range of surfaces” and is a key feature in JaguarÂ’s F-Pace and Land Rover Discovery vehicles. “JLR seeks to protect itself and its United States operations from companies that have injected infringing products into the U.S. market that incorporate, without any license from JLR, technology developed by JLR and protected by its patent,” JaguarÂ’s lawyer, Matthew Moore, said in the filing. Representatives of Volkswagen didnÂ’t immediately respond to emails seeking comment on the complaint. Jaguar wants to block imports of PorscheÂ’s Cayenne; LamborghiniÂ’s Urus; AudiÂ’s Q8, Q7, Q5, A6 Allroad and e-tron vehicles; and VWÂ’s Tiguan vehicles. It said there are plenty of other luxury midsize SUV and compact crossover vehicles to meet consumer demand if the SUVs are banned from the U.S. Still, the premium Porsche and Audi lines provide much of the profit VW is using to fund its investments in technology for electric vehicles, autonomous vehicles and further innovations. In addition to the four brands, Volkswagen Group owns other upscale nameplates, including Bentley and Bugatti. The International Trade Commission is an independent, quasi-judicial agency that investigates complaints of unfair trade practices, like patent infringement. It canÂ’t award damages but does have the power to block products from entering the U.S. Owners of patents and trade secrets like it because it can work faster than the federal district courts -- the typical investigation is completed in 15 to 18 months. But Jaguar also filed patent lawsuits against the companies in federal courts in Delaware and New Jersey, seeking cash compensation for the use of the technology. Those cases are likely to be put on hold once the trade commission launches its investigation.
