EPA discovers defeat device in more VW TDI engines

In a sternly worded letter, the United States Environmental Protection Agency has issued a new set of allegations against Volkswagen claiming that so-called emissions defeat software has been found in the company's 3.0-liter TDI V6 diesel engines. This is a completely different engine than the 2.0 TDI that has already been identified as an emissions cheater. In addition to VW, the EPA has included Audi and Porsche in this notification, as the non-compliant engine has been used in vehicles from all three manufacturers from model years 2014 through 2016. The EPA claims that cars equipped with the 3.0 TDI engine know when they are being tested for emissions, and their on-board computers switch into a mode designed to pass the stringent requirements in the United States for diesel exhaust. Vehicles sold in the United States with this engine include the 2014 VW Touareg, 2015 Porsche Cayenne, and 2016 Audi A6, A7, A8L and Q5. The EPA says there are 10,000 vehicles currently on the road with this second defeat device, along with an unknown number of 2016 models either on dealer lots or in the driveways of consumers. According to the EPA, VW's 3.0-liter TDI, like the 2.0 TDI that was found to circumvent US regulations, has code in its computer specifically written to intentionally put the vehicle's engine into a mode that allows it to meet exhaust requirements. When the vehicle is unhooked from testing equipment, it will go back into a mode that emits nine-times higher nitrogen oxide emissions than is allowable under US law. "VW has once again failed its obligation to comply with the law that protects clean air for all Americans," said Cynthia Giles, Assistant Administrator for the Office for EPA's Enforcement and Compliance Assurance. "All companies should be playing by the same rules. EPA, with our state, and federal partners, will continue to investigate these serious matters, to secure the benefits of the Clean Air Act, ensure a level playing field for responsible businesses, and to ensure consumers get the environmental performance they expect." Richard Corey, Executive Officer of the California Air Resources Board, said in a statement, "Today we are requiring VW Group to address these issues. This is a very serious public health matter. ARB and EPA will continue to conduct a rigorous investigation that includes testing more vehicles until all of the facts are out in the open." Roger Rodas' Widow Suing Porsche Over Carrera GT Crash

Investigations undertaken by local law enforcement may have vindicated Porsche from any wrongdoing in the crash that killed actor Paul Walker and racing driver Roger Rodas last year, but the latter's widow is apparently not convinced. According to emerging reports, Kristine Rodas has filed a lawsuit seeking unspecified damages from Porsche Cars North America. In her suit filed with the Los Angeles Superior Court, Rodas' attorney Mark Geragos reportedly disputes the findings of the Los Angeles County Sheriff's Department, which asserted that the vehicle was traveling at an unsafe speed of 90 miles per hour on city streets, identifying the speed as the cause of the accident. Instead the lawsuit claims that the vehicle was only going 55 mph and that the cause of the crash was improper equipment – namely a faulty right rear suspension and the lack of a crash cage and proper fuel tank. "The Carrera GT was unsafe for its intended use by reason of defects in its manufacture, design, testing, component and constituents, so that it would not safely serve its purpose," according to the specifics of the suit obtained by the Los Angeles Times. When reached for comment, Porsche Cars North America spokesman Nick Twork told Autoblog: We are very sorry for the Rodas and Walker family's loss. The crash was the subject of a detailed investigation by the proper authorities (L.A. County Sheriff and California Highway Patrol), and their investigation disproves the allegations in the lawsuit. The investigation found that driving at a high speed in a negligent manner caused the crash and concluded that there was no mechanical defect. The Carrera GT is known as a difficult car to drive. As the LA Times report points out, Jay Leno spun one at Talladega in 2005, and the following year, Porsche paid part of a multi-million-dollar settlement after two were killed on a track when their Carrera GT struck a slower-moving Ferrari. The Rodas lawsuit could very well point to that previous suit from San Diego Superior Court. Whether the court in LA will hand down a similar ruling remains to be seen.

Former chairman Piech opposing his nieces' VW board nominations

Someone needs to option the rights to the Ferdinand Piech story for an HBO series, because it perfectly mixes the corporate intrigue of Mad Men with the family drama of The Sopranos. Plus there are some cool cars. In the latest episode, Piech isn't happy with Volkswagen's appointment of two of his nieces – Julia Kuhn-Piech and Dr. Louise Kiesling – to replace he and his wife on the automaker's supervisory board. The recently ousted chairman could try to stop them. According to German publication Bild, Piech thinks his two relatives lack the necessary automotive experience to serve on the board. Therefore, he suggests one-time Ford Premier Automotive Group boss Wolfgang Reitzle and former Siemens manager Brigitte Ederer to take the seats. However, a VW spokesperson told Automotive News Europe that there were no objections to the women's appointment, except for this story from Germany. Piech's nieces are already officially appointed to the VW supervisory board, and it's approved by the Braunschweig Local Court in Germany. His only real option to challenge them would be to file a lawsuit, according to Automotive News Europe. While the new appointees don't have their uncle's decades of history in the auto industry, they do have business experience. Dr. Kiesling has a degree in vehicle design from the Royal College of Art in London and is the managing director of an Austrian textile maker. Kuhn-Piech works in real estate sits on the supervisory board of German truck maker Man.
