Nissan's Taxi of Tomorrow shut down by NYC courts [UPDATE]

Justice Schlomo Hagler may have just put a big dent in Nissan's plans to rule New York City's taxi fleets and outgoing Mayor Mike Bloomberg's vision of a unified fleet of yellow cabs.
As an October 28 deadline approached that would see all current, non-hybrid taxis replaced over by the Nissan NV200 over a three-to-five-year span, the legal battle that's enveloped the Taxi of Tomorrow program from the start has intensified. In a lawsuit, the Greater New York Taxi Association claims New York's Taxi and Limousine Commission overstepped its powers in mandating that taxi fleets are refitted with the NV200, according to the New York Daily News. This isn't the first time the courts have sided with the cabbies in the ToT debate.
Justice Hagler agreed with the cabbies, striking down the Taxi of Tomorrow purchasing requirements, and saying, "Simply stated, the power to contract and compel medallion owners to purchase the Nissan NV200 from Nissan for ten years does not exist in the City Charter," according to The Wall Street Journal.

Vermont electric utility Green Mountain Power is selling discounted Tesla Powerwalls to its customers in hopes of balancing the grid. The battery packs would be used not just to help customers store renewable energy for home solar systems or as backup power, but also to occasionally discharge power back to the grid when needed. In addition to this decentralized energy storage being useful to customers, it also benefits the utility by taking demand off energy generating infrastructure during periods of peak demand. Together, Nissan and Renault have built 340,000 electric cars. The allied Japanese and French automakers hit 100,000 EVs in July 2013, 200,000 in November 2014, and a quarter million in June of 2015. The Nissan Leaf, which first went on sale at the end of 2010, makes up the bulk of the EVs the Renault-Nissan Alliance has sold. Renault delivered its 50,000th Zoe EV in April 2016. Leaf sales have declined in the US in recent months, due at least in part to the anticipation of the Chevrolet Bolt and Tesla Model 3. Students at the Bearys Institute of Technology (BIT) in Karnataka, India have built what they call the Hybrid Water Car. The car uses a system to electrolyze hydrogen from water and add it to the fuel for more efficient combustion. The system has been placed into a chopped up, lightweighted Maruti Omni. While the benefits of onboard hydrogen electrolyzers have been debated for some time, the BIT students don't plan to stop there, as their next project car will be fueled completely by hydrogen. Nissan expands Ghosn probe to more countries, executive Munoz under scrutiny, sources say

BEIJING — Nissan Motor Co Ltd has broadened its investigation into ousted chairman Carlos Ghosn to include dealings that took place in the United States, India and Latin America, three people with knowledge of the inquiry said. In one aspect of their internal probe, company investigators are looking into decisions made in the United States by Jose Munoz who led Nissan's North American operations from 2014 to 2018, the people said. Munoz was recently placed on a leave of absence due to the probe, they added. Nissan said this month that Munoz, its chief performance officer and widely seen within the industry as close to Ghosn, was on leave "to allow him to assist the company by concentrating on special tasks arising from recent events." Munoz is not cooperating with investigators, two of the people with knowledge of the probe said, both describing his actions as "stonewalling". One of the sources described Munoz, who currently heads Nissan's China operations, as a "person of interest" in the probe, adding that it was not clear whether he would be accused of any wrongdoing. Munoz, 53, did not reply to Reuters requests for comment. The people with knowledge of the probe spoke to Reuters on condition of anonymity due to the sensitivity of the matter. A lawyer for Ghosn, Motonari Otsuru, said in an emailed comment: "I am unaware of this." Some of the questions put to Munoz relate to dealer franchise rights, one of the sources said. Other questions relate to contracts with parts suppliers and service providers that Munoz approved when he was at the helm of Nissan's U.S. operations, another source said. The sources said the findings made as part of the probe into Ghosn's affairs in the U.S. market are being shared with prosecutors. Tokyo prosecutors declined to comment. Nissan has said its internal investigation had uncovered "substantial and convincing evidence of misconduct" by Ghosn and that its scope is expanding. Ghosn, once the most celebrated executives in the auto industry and the anchor of Nissan's alliance with France's Renault SA, has been charged with under-reporting his income. On Friday, he was also charged with aggravated breach of trust, accused of shifting personal investment losses worth 1.85 billion yen ($17 million) to Nissan.
