Tokyo court rejects Carlos Ghosn's bail request

TOKYO — A Tokyo court rejected former Nissan chairman Carlos Ghosn's latest request for bail on Tuesday, more than two months after his arrest. A statement from the Tokyo District Court announcing its decision gave no explanation for prolonging a detention of the 64-year-old executive, which has drawn international scrutiny of Japan's justice system. Ghosn had promised to wear an electronic monitoring ankle bracelet, give up his passport and pay for security guards approved by prosecutors in his latest attempt to gain release from a Tokyo detention center. His family said they will appeal. Ghosn has been in custody since Nov. 19. He had a bail hearing Monday. A Tokyo court rejected an earlier request for bail last week. Ghosn, who led Nissan Motor Co. for two decades, has been charged with falsifying financial reports in underreporting his compensation from Nissan over eight years, and with breach of trust, centering on allegations Ghosn had Nissan temporarily shoulder his personal investment losses and pay a Saudi businessman. Ghosn has said he is innocent, explaining that the alleged compensation was never decided, Nissan didn't suffer losses and the payment was for legitimate services. His wife, Carole Ghosn, appealed for his release through Human Rights Watch earlier this month, saying Ghosn's treatment has been harsh and unfair. Her views echo widespread criticism of Japan's criminal justice system both inside and outside Japan. Suspects who insist they are innocent get held longer. Suspects are held in a cell and routinely grilled daily by investigators without a lawyer present, although lawyers are allowed to visit. Ghosn's lawyer Motonari Ohtsuru has acknowledged Ghosn's release may not come until the trial, which may be six months away. A date for the trial has not been set. Nissan officials say an internal investigation has found that Ghosn had schemes to hide his income and that he used company money and assets for personal gain. A special committee Nissan set up after Ghosn's arrest to strengthen governance held its first meeting Sunday. Seiichiro Nishioka, a former judge and co-chair, told reporters after the meeting that Ghosn had shown questionable ethics, and too much power within the company had been focused in one person. The committee's findings are due by late March. Ghosn's pay was long a sticking point in Japan, where executives generally get paid far less than their American and other Western counterparts.

North Carolina now charging $100-per-year EV road-use fee

Tobacco Road just got a little more expensive for drivers of electric vehicles such as the Nissan Leaf and Tesla Model S. This year, North Carolina started instituting an annual $100 road-use fee for electric-vehicle drivers in order to close at least a little of the budgetary shortfall for road maintenance in the Tar Heel State, the News Observer reports. North Carolina legislators failed to green-light a hybrid-vehicle fee of $50 a year, which may have made a little more of a dent in the state's road funding. As it is, about 1,600 EVs are registered in North Carolina, meaning that the state will collect about $160,000 in such fees this year. And while some in the state are concerned that the fee could hurt EV adoption, others say it's fair because of the $7,500 in federal tax credits EV buyers get. Oh, and the fact that EV drivers don't pay gasoline taxes. Either way, the fees are a proverbial drop in the bucket, as North Carolina's transportation shortfall is estimated to average about $2 billion a year during the next three decades or so. Other states are starting to charge EV drivers a road-use fee as well. Last February, Washington State began instituting its own electric-vehicle fee of $100 per annum, and a number of other states are considering similar policies. Nissan leaning on JATCO to remedy CVT problems

Nissan's decision to fit continuously variable transmissions across even more of its new models may be coming back to bite the Japanese automaker, as it's been hampered by customer satisfaction issues relating to its XTronic CVTs, which are provided by a supplier called JATCO.
From what we're understanding, the issue largely relates to customers' unfamiliarity with the non-traditional shift nature of a CVT. Dealers have reported complaints and service visits from owners over the belt-driven automatics (did these people not test drive the cars before they bought them and notice that they don't shift conventionally?).
The company, which Nissan owns 75 percent of, has come under fire from none other than Nissan CEO Carlos Ghosn, who's spoken about JATCO and its troubles rather openly. "Every time you launch a new CVT you always have some risks," Ghosn said in an interview with Automotive News. "So we now have a process by which, before we launch any new CVT, [JATCO] come before the Nissan executive committee to explain all the measures they have taken to make sure there are no surprises."
