NYC Taxi of Tomorrow ruled legal by appeals court

The streets of New York City might be filling up with a lot more Nissans in the next few years. A New York appeals court ruled that the city's mandate to replace old taxis with a fleet entirely made up of the Nissan NV200 Taxi of Tomorrow was legal. The decision overturned a previous ruling that decided The Big Apple couldn't force cabbies to all purchase the same vehicle.
Justice David B. Saxe wrote the court's opinion saying the Taxi of Tomorrow is a "legally appropriate response to the agency's statutory obligation to produce a 21st-century taxicab consistent with the broad interests and perspectives that the agency is charged with protecting," according to Bloomberg. The Greater New York Taxi Association, the plaintiff in the case, could still possibly attempt a second appeal.
Nissan originally won the 10-year contract estimated to be worth about $1 billion in 2011, beating out Ford and a Turkish company. Under the Taxi of Tomorrow plan, all New York cabbies would have to switch to the NV200 within three of five years of the van going into service, and it would replace the 16 vehicles previously authorized as taxis. In 2013, the mandate received multiple challenges though, including an attempted ban by cab drivers because the replacement wasn't a hybrid. In a separate case, state Supreme Court judge Schlomo Hagler decided that there was nothing in the city charter that forced a taxi driver to choose a specific vehicle. This was the case that was just overturned. In the meantime, the automaker has been selling the NV200 to New York cabbies at prices around $29,700.

Nissan recalling 909k vehicles globally over accelerator issue

Nissan is issuing a massive recall that will see the Japanese automaker repair 908,900 vehicles worldwide, with nearly 100,000 of the affected models in the United States. While an official recall notice from Nissan or the National Highway Traffic Safety Administration is not yet available, Reuters has been able to confirm the recall with Nissan.
Nissan's recall is kind of the opposite of the Toyota unintended acceleration, in that it covers a lack of acceleration. According to the report, a sensor in the gas pedal can develop faults, leading to a sluggish acceleration or an outright stall regardless of how much throttle the driver dials in. The huge recall covers mostly Japanese domestic models like the Serena, X-Trail, Lafesta and Fuga, which make up for 764,800 of the 908,900 faulty vehicles. However, 98,300 Infiniti M sedans are being recalled in the US, although it's unclear at this time which model years and trims are affected. The remaining vehicles are found in Europe and Oceania, according to Nissan spokesman Chris Keefe.
No injuries or accidents have been reported due to the faults. The 90-minute repair will see techs replace the accelerator pedal and tweak the engine control programs. We'll update this story as soon as Nissan or NHTSA makes an official statement.

Chairman Carlos Ghosn, who was widely respected for rescuing the carmaker from near bankruptcy, was arrested on Monday for alleged financial misconduct. Saikawa said he couldn't elaborate as the cases are being investigated by prosecutors, who have declined to comment. Prosecutors said that Ghosn and Kelly conspired to understate Ghosn's compensation over five years starting in fiscal 2010 as being about half of the actual 9.998 billion yen ($88.9 million). Public broadcaster NHK said Nissan paid billions of yen to buy and renovate homes for Ghosn in Rio, Beirut, Paris and Amsterdam, citing unnamed sources. The properties had no business purpose and were not listed as benefits in TSE filings, NHK said. Ghosn, 64, has not been formally charged. The Asahi newspaper reported that he and Kelly had submitted to prosecutors' questions after getting off a plane on Monday afternoon at Tokyo's Haneda Airport. Saikawa confirmed they had been arrested. Ghosn and Kelly have not been seen since, and their exact whereabouts are not known. Suspects are typically taken to the Tokyo Detention Center, which is linked to the Tokyo District Public Prosecutors Office. How did this come to light? Nissan's Saikawa said Ghosn's alleged improprieties came to light through a whistleblower, after which the company began an internal investigation and informed prosecutors. Japanese media reports say the informant is a member of Nissan's legal department. The Asahi reported, without citing sources, that the informant gave the prosecutors information in a plea bargain, implying the person may have provided evidence in exchange for a lighter sentence.
