Tokyo court rejects Carlos Ghosn's bail request

TOKYO — A Tokyo court rejected former Nissan chairman Carlos Ghosn's latest request for bail on Tuesday, more than two months after his arrest. A statement from the Tokyo District Court announcing its decision gave no explanation for prolonging a detention of the 64-year-old executive, which has drawn international scrutiny of Japan's justice system. Ghosn had promised to wear an electronic monitoring ankle bracelet, give up his passport and pay for security guards approved by prosecutors in his latest attempt to gain release from a Tokyo detention center. His family said they will appeal. Ghosn has been in custody since Nov. 19. He had a bail hearing Monday. A Tokyo court rejected an earlier request for bail last week. Ghosn, who led Nissan Motor Co. for two decades, has been charged with falsifying financial reports in underreporting his compensation from Nissan over eight years, and with breach of trust, centering on allegations Ghosn had Nissan temporarily shoulder his personal investment losses and pay a Saudi businessman. Ghosn has said he is innocent, explaining that the alleged compensation was never decided, Nissan didn't suffer losses and the payment was for legitimate services. His wife, Carole Ghosn, appealed for his release through Human Rights Watch earlier this month, saying Ghosn's treatment has been harsh and unfair. Her views echo widespread criticism of Japan's criminal justice system both inside and outside Japan. Suspects who insist they are innocent get held longer. Suspects are held in a cell and routinely grilled daily by investigators without a lawyer present, although lawyers are allowed to visit. Ghosn's lawyer Motonari Ohtsuru has acknowledged Ghosn's release may not come until the trial, which may be six months away. A date for the trial has not been set. Nissan officials say an internal investigation has found that Ghosn had schemes to hide his income and that he used company money and assets for personal gain. A special committee Nissan set up after Ghosn's arrest to strengthen governance held its first meeting Sunday. Seiichiro Nishioka, a former judge and co-chair, told reporters after the meeting that Ghosn had shown questionable ethics, and too much power within the company had been focused in one person. The committee's findings are due by late March. Ghosn's pay was long a sticking point in Japan, where executives generally get paid far less than their American and other Western counterparts.

At this point last year, we'd been getting news on automotive-focused Super Bowl commercials for more than two months. The teasers hadn't come out yet, but manufacturers lined up for the super-expensive spots were making their intentions known. This year? Almost nada, until this week. BMW has said it will air a 60-second spot promoting the i3 during the first quarter of the game, the Munich firm returning to The Big Game after a four-year absence. BMW says, "Big ideas like the BMW i3 take a little getting used to, and the creative idea surrounding our spot will play on this analogy." We say that pitching a tiny range-extended hatchback during the beer-iest American sports orgy of the year should make for some neat commentary afterward. Lexus is putting its new NX crossover in the second Super Bowl commercial it's ever aired, eschewing the glitter of celebrities and glamor for a straight-shooting spot and the tagline, "Be seen, be heard, make some noise." Joining those two are Kia, Mercedes-Benz, Nissan and Toyota. The six confirmed carmakers are down from eleven last year, when car spots made up a quarter of the total ad time. The price to do business for 30 seconds this year: reportedly around $4.5 million, up a stacks from last year's $4 million. Nissan Leaf's lead over Renault Zoe narrows in Europe

The Nissan Leaf has seen its sales steadily decline in the US for a while now. Here, its been eclipsed by the second-generation Chevrolet Volt extended-range plug-in while people await the next-generation version of the all-electric Leaf. The EV may be starting to receive a similar response across the Pond. While the Leaf remains Europe's biggest-selling EV, that lead is eroding, as sales of the Renault Zoe are catching up, according to the European Alternative Fuels Observatory (EAFO). It's a good thing Nissan and Renault are sister companies. Through May, Nissan sold about 9,500 Leaf vehicles in Europe. The good news is that number is up 37 percent from a year earlier. There's disconcerting news, too, and that is that the Renault Zoe's sales have surged 60 percent this year to almost 9,400 units. So, for all we know, the Zoe may have caught up with the Leaf last month. Still, both models are outpacing demand for the Tesla Model S and Volkswagen e-Golf: the former's sales are little-changed this year, while the latter model's sales have dropped 34 percent. The BMW i3, Kia Soul EV, and Mercedes-Benz B250e all have had higher sales this year. As for plug-in hybrids, the Mitsubishi Outlander PHEV has maintained its substantial European lead, almost doubling sales of the Volkswagen Golf GTE and totaling almost 9,400 units sold through May. Meanwhile, the new Volvo XC90 PHEV has leapfrogged models such as the Volkswagen Passat GTE, Mercedes-Benz C350e, and Audi A3 e-Tron into third place behind the Mitsubishi and VW. Here in the US, Nissan Leaf sales through June fell 41 percent from a year earlier to about 5,800 units, while Chevrolet Volt sales have surged 75 percent to 9,808 units.
