Japan issues arrest warrants for Ghosn, Americans suspected of helping him escape

They are suspected of smuggling Carlos Ghosn out of Japan to Lebanon via Istanbul.   TOKYO — Tokyo prosecutors issued an arrest warrant Thursday for Nissan's former chairman Carlos Ghosn, who skipped bail while awaiting trial in Japan and is now in Lebanon. Japan has no extradition treaty with Lebanon, so he's unlikely to be arrested. Lebanon has indicated it will not hand over Ghosn. Tokyo prosecutors also issued arrest warrants for three Americans they said helped and planned his escape, Michael Taylor, George-Antoine Zayek and Peter Taylor. Deputy Chief Prosecutor Takahiro Saito declined to say where the three men were thought to be staying. He said Michael Taylor and George Zayek are suspected of helping Ghosn flee by hiding him in cargo at a Japanese airport and getting him into a private jet to leave the country. Saito would not say if Japan has asked U.S. authorities for help, though he said all options were being explored. Japan and the U.S. have an extradition treaty. Michael Taylor is a former Green Beret and private security specialist. Peter Taylor appears to be his son. Security footage released earlier showed Zayek and Taylor transiting Istanbul Airport at the same time Ghosn allegedly passed through Turkey on his way to Beirut. Prosecutors suspect Peter Taylor met several times with Ghosn in Tokyo, starting in July last year, to plot his escape. Saito said Ghosn was given a key to a hotel room in Osaka near the Kansai Airport that Ghosn left from. Prosecutors say Ghosn broke the law by violating bail conditions that required him to stay in Japan, mostly at his Tokyo home. “We want to stress that the act of fleeing was clearly wrong,” Saito told reporters. “We need to erase the misunderstanding.” Separately, Saito said prosecutors on Wednesday forced open a lock to search the Tokyo office of Ghosn's former defense lawyer Junichiro Hironaka for records of people Ghosn met with while out on bail, and other materials. Prosecutors are asking a judge for help in accessing contents of a computer Ghosn used at Hironaka's office that the lawyer has refused to hand over, citing attorney-client privilege. Ghosn has said he is innocent of allegations he under-reported his future income and committed a breach of trust by diverting Nissan money for his personal gain.

Nissan Leaf sets new November sales record, Chevy Volt drops again

When you talk to people in the plug-in vehicle industry, one theme you hear repeatedly is that the more plug-in cars that are out there, the better things are for everyone. One reason is that more EVs build a need for more public chargers, and more chargers mean more people see that plugging in is feasible. But there's still something to be said for old-fashioned competition, and in the sales race between the two long-running plug-in vehicles in the US, the Nissan Leaf is resoundingly beating the Chevy Volt for 2014. In fact, it won't be long before the EV's cumulative sales top the PHEV's. But that's a topic for another month. For now, we have the sales results from November. Unsurprisingly, Nissan set another monthly record (that is, the best Leaf sales in any November, the 22nd time in a row we've seen a monthly record) with 2,687 sales last month. That's up 34 percent over last November and up 35 percent year-to-date. Toby Perry, Nissan's director of electric vehicle marketing, said in a statement that, "Our 'Kick Gas' ad campaign and 'No Charge to Charge' launch in Chicago and Atlanta drove an increase in November Leaf sales. Even with gas prices falling across the country, consumers appreciate that the cost of driving a Nissan Leaf is still a fraction of that of a gas-powered car." Over on the Chevy side of the ledger, there were 1,336 Volt sales last month, down 30.4 percent from the 1,920 sold in November 2013. So far this year, Volt sales are down 16.4 percent and Chevy has sold 17,315 Volts in 2014. As we said last month, the Volt slump might be due to people waiting on the new version to make an appearance at the Detroit Auto Show next month before going on sale in the second half of 2015. Lebanon has 40 days to figure out what to do with Carlos Ghosn

BEIRUT — Lebanon and Japan have about 40 days to decide whether ousted Nissan boss Carlos Ghosn will be extradited to Japan or stand trial in Lebanon, a judicial source and a source close to Ghosn said on Thursday, following his escape from Japan. Ghosn fled to Lebanon, his childhood home, as he was awaiting trial on charges of under-reporting earnings, breach of trust and misappropriation of company funds, all of which he denies. Japan and Lebanon have no extradition agreement, and Lebanon does not typically hand over its nationals. Ghosn's legal team is hoping to hold the trial in Lebanon, where the former auto executive has deep ties and hopes to clear his name. Japan has in recent days asked Lebanon to clarify what files Tokyo needs to send as part of an official extradition request, the two sources said. "They came back and requested a clarification. Today, we sent that to the Japanese," the judicial source said. That communication is significant because, according to Lebanon's rules for dealing with Interpol notices, it triggers a roughly 40-day period by the end of which agreement must be reached between the countries on where and how Ghosn will stand trial, the sources said. Japan must now either send a formal extradition request to Lebanon or send Ghosn's file to Beirut and agree on a process for trying him there, the source close to Ghosn said. An Interpol spokesperson said on Friday the organization did not itself dictate a timeframe or require any action to be taken by countries and such a framework is set locally. Ghosn, who holds Lebanese, French, and Brazilian nationality, was questioned earlier this month by Lebanese prosecutors who confiscated his passport and imposed a travel ban as part of the Interpol arrest warrant process. The source close to Ghosn said the former executive can appeal to Lebanon's prosecutor to drop the ban and return his passport if Japan does not respond within the timeframe. Japanese prosecutors have said they are still pushing for Ghosn to be tried in Japan. Ghosn has struck out at what he has called Japan's unjust judicial system and said the alternative to fleeing would have been to spend the rest of his life languishing in Tokyo without a fair trial.
