Renault to Nissan: Stop trying to contact our board members

TOKYO/PARIS — Renault told alliance partner Nissan to stop contacting the French company's directors ahead of a Thursday board meeting as the Japanese automaker tried to share evidence of wrongdoing by its ousted chairman, Carlos Ghosn, two sources said. Ever since Ghosn's Nov. 19 arrest in Japan, Renault and the French government, the automaker's biggest shareholder, have demanded to see the findings of a Nissan internal investigation that include allegations of financial misconduct by the 64-year-old executive. Ghosn was charged on Monday in Japan for failing to declare deferred income he had agreed to receive for the five years ending March 2015. While Nissan fired him as chairman days after his arrest, he remains chairman and CEO of its French partner. Renault's board meets on Dec. 13, and the findings of Nissan's investigation will be shared at the meeting where Ghosn's future could be also debated, one of the sources with knowledge of the matter said. The French firm told Nissan not to contact its directors ahead of the meeting, because such contact was outside the agreed channels for communication of the sensitive findings, the source said. Nissan offered last week to brief Renault's board about findings on what it considers proof of wrongdoing by Ghosn, said a second source who has knowledge of the matter but declined to be identified as it was confidential. But Renault advised Nissan to brief its lawyers instead, which led to a meeting between the Japanese firm's officials and Renault's legal teams early this week in Paris, the person said. The Japanese automaker later invited Thierry Bollore, who was named Renault's deputy CEO with the same powers as Ghosn a day after his arrest, as well as board members, to examine the contents of the findings, said the source. Bollore, though, told Nissan on Tuesday to "refrain from contacting the board," the source said. The exchange between Renault and Nissan is another example of the testy relationship between the two automakers, despite assurances by executives on both sides to preserve the alliance. The alliance, of which Ghosn has been the driving force, is widely seen as vital for the members' long-term survival. Board members invited to see the evidence included Martin Vial, who heads the French state shareholdings agency, interim Chairman Philippe Lagayette and independent director Patrick Thomas, the second source said. A Renault spokesperson declined to comment.

Public broadcaster NHK said Nissan paid billions of yen to buy and renovate homes for Ghosn in Rio, Beirut, Paris and Amsterdam, citing unnamed sources. The properties had no business purpose and were not listed as benefits in TSE filings, NHK said. Ghosn, 64, has not been formally charged. The Asahi newspaper reported that he and Kelly had submitted to prosecutors' questions after getting off a plane on Monday afternoon at Tokyo's Haneda Airport. Saikawa confirmed they had been arrested. Ghosn and Kelly have not been seen since, and their exact whereabouts are not known. Suspects are typically taken to the Tokyo Detention Center, which is linked to the Tokyo District Public Prosecutors Office. How did this come to light? Nissan's Saikawa said Ghosn's alleged improprieties came to light through a whistleblower, after which the company began an internal investigation and informed prosecutors. Japanese media reports say the informant is a member of Nissan's legal department. The Asahi reported, without citing sources, that the informant gave the prosecutors information in a plea bargain, implying the person may have provided evidence in exchange for a lighter sentence. The arrest and detention of its former chairman, Carlos Ghosn, prompted Nissan at the last minute to pull the plug on plans to debut a longer-range version of its Leaf battery- electric car at the Los Angeles auto show, The Wall Street Journal reports. Nissan instead showed two mild-refresh models for 2019 — the Maxima sedan and the Murano crossover. It had reportedly hoped to make a bigger splash by unveiling the upgraded Leaf with actress and brand ambassador Margot Robbie at a media event at the Japanese American National Museum. It went ahead with an event at the venue, showing current models of the Leaf and holding the Nissan Futures event, the first time the series of panel discussion and keynote addresses had been staged in the U.S., with Robbie sitting down for a brief interview about owning an EV and sustainability issues. "The official announcement regarding details of the 2019 Nissan Leaf with additional performance capabilities is postponed to a later date," the company said in a statement. A spokesman told the Journal the postponement was "to ensure that this important product unveiling could receive the coverage it merits." Ghosn was arrested Nov. 19 in Japan on allegations of financial misconduct, including what Nissan has said was personal use of company money and deliberately under-reporting what he had been paid. Both Nissan and alliance partner Mitsubishi have ousted Ghosn as chairman, though his status remains unchanged for now at Renault, the third member of the partnership where he is both chairman and CEO. Renault has appointed a stand-in replacement while Ghosn remains in custody. Reuters reports that Tokyo authorities extended Ghosn's detention a second time Friday and have until Dec. 10 to file charges or release him. The auto world has been widely anticipating a longer-range version believed to be called the Leaf E-Plus, with a 60-kWh battery pack and an expected driving range of around 225 miles, up from the 40-kWh battery and 151-mile driving range of the current model. A recent report suggests that its starting price will be about $5,500 more than the 40-kWh version, meaning around $36,385 before federal EV tax credits. A spokesman tells Autoblog the postponement doesn't affect the new Leaf's on-sale date but added that date has yet to be announced.
