Ex-Nissan chairman Carlos Ghosn indicted, may remain in jail for months

TOKYO — Nissan's ex-chairman Carlos Ghosn was charged Friday with breach of trust, according to the Tokyo District Court, making the star executive's release unlikely for months. Ghosn, arrested Nov. 19, was earlier charged with falsifying financial reports in underreporting his income by about 5 billion yen ($44 million) over five years through 2015. Ghosn; Greg Kelly, another Nissan executive; and Nissan as a legal entity also were charged Friday with additional underreporting of income, from 2015 through mid-2018. Ghosn's lawyer Motonari Ohtsuru said he would request that Ghosn be granted release on bail. His detention period for the breach of trust allegations was due to expire Friday. Kelly and Nissan were not charged with breach of trust. Those allegations center on Ghosn's handling of investment losses and payments made to a Saudi businessman. Ghosn, 64, says he's innocent. Suspects in Japan are routinely held for months until trials start, and Tokyo prosecutors maintain that Ghosn, a Brazilian-born Frenchman of Lebanese ancestry, is a flight risk. Earlier this week Ghosn told a Tokyo court he was innocent, in his first public appearance since his arrest, and appealed for his detention to end. But the court rejected that request. "I have a genuine love and appreciation for Nissan," Ghosn told the court. "In all of my efforts on behalf of the company, I have acted honorably, legally and with the knowledge and approval of the appropriate executives inside the company." He said the compensation was never decided on, the investment deal never resulted in any losses to Nissan, and the payments to the Saudi businessman were for legitimate services related to dealers and investments in the Gulf. Ghosn, who appeared much thinner than before his arrest, came down with a fever the day after his court appearance, but has since recovered, Ohtsuru, the lawyer, said. His wife Carole Ghosn issued a statement overnight out of Paris, expressing concern over his sickness. "I am pleading with the Japanese authorities to provide us with any information at all about my husband's health. We are fearful and very worried his recovery will be complicated while he continues to endure such harsh conditions and unfair treatment," she said. Apart from prosecutors, only embassy officials and Ghosn's lawyers are allowed to visit him. Such visits were canceled Thursday but resumed Friday.

2018 Mitsubishi Eclipse Cross arrives in the U.S., pricing starts at $24,290

The first shipment of the 2018 Mitsubishi Eclipse Cross has arrived in the United States. Mitsubishi's new all-wheel drive compact crossover will go on sale in showrooms in early March with a starting price of $24,290, including a destination charge of $995. The Eclipse Cross debuted last year at the Geneva Motor Show with design cues borrowed from the XR-PHEV II Concept from 2015. The exterior design, which Mitsubishi says is inspired by a runner in the "Get set" position, includes a forward-raked rear window, wedge profile and deep side crease. Its starting price slots it just below competitors like the Honda CR-V and Hyundai Tucson, and it will come in four trim levels. Those include the base ES, which is the only trim available with front-wheel drive. Adding all-wheel drive, or S-AWC in Mitsubishi speak, adds only $600 to the base price. The LE S-AWC trim starts at $25,890 and the range-topping SE S-AWC starts at $27,390, though neither are eligible for options, so those are pretty much the prices customers will be dealing with. All trim levels are powered by a direct-injection turbocharged 1.5-liter inline-four that makes 152 horsepower and 184 pound-feet of torque. The S-AWC acronym would stand for Super All-Wheel Control, Mitsubishi's system that manages torque supplied to each wheel for added straight-line stability and cornering performance. It offers three selectable driving modes — auto, snow and gravel — to enhance performance. Safety technology includes blind-spot warning and lane-change assist, forward collision mitigation and lane-departure warning, plus a system that automatically adjusts headlight brightness to the conditions. Interior features include an available 7-inch infotainment display with a touchpad controller, Apple CarPlay and Android Auto, plus voice recognition via Google Assistant or Siri. There's also a full-color LCD head-up display available. A dual-pane sunroof and heated rear seats are some of the other niceties. The Eclipse Cross joins the brand's stable of crossovers, the Outlander and slightly smaller Outlander Sport, which helped Mitsubishi to a banner year in 2017, selling more than 100,000 vehicles for the first time in a decade. 2015 Mitsubishi Outlander Sport recalled for leaky transmission

The Basics: Mitsubishi Motors is recalling 45,731 Outlander Sport crossovers from model year 2015. Built between June 25, 2014 and November 25, 2015, the affected vehicles use the base 2.0-liter four-cylinder engine and continuously variable transmissions. The Problem: A clamp on the CVT hose may have been installed incorrectly. If the hose comes off, transmission fluid can leak out. While the transmission will start acting up – and eventually grind to a halt – the bigger concern is what happens if the transmission fluid comes into contact with hot surfaces: fire. Injuries/Deaths: Thankfully, it doesn't sound any owners have crashed, caught fire, or been injured or killed due to loss of transmission fluid. Mitsubishi didn't list injuries or fatalities in its recall paperwork with NHTSA, but the chronology only describes "warranty claims," which sounds like the vehicles never caught fire. The Fix: Dealers will inspect the hose clamps on all 45,000 Outlander Sports and reinstall them if there's a problem. Repairs are free of charge. If you own one: Since NHTSA's bulletin doesn't advise owners on whether they should or shouldn't drive their vehicles, we recommend looking for leaks and checking your transmission fluid level as soon as possible. If it's low or leaking, you probably shouldn't drive.
