Dutch court orders Ghosn to repay Nissan-Mitsubishi $6 million in wages

AMSTERDAM — A court in Amsterdam on Thursday ordered fugitive former car executive Carlos Ghosn to repay Nissan and Mitsubishi almost 5 million euros ($6.1 million) in wages he received from their Dutch registered joint venture Nissan-Mitsubishi BV in 2018. Nissan and Mitsubishi, which ousted Ghosn as chairman of their companies and of their joint venture after his arrest for financial misconduct in 2018, claimed Ghosn had wrongly granted the wages to himself. Ghosn had brought the case himself, demanding 15 million euros in compensation for missed wages and severance payments as he claimed Nissan and Mitsubishi had violated Dutch labor laws when they dismissed him from the Amsterdam-based joint venture in 2019. But the district court in Amsterdam sided with the car companies, stating that Ghosn did not have a valid employment agreement with the joint venture, as it lacked the required consent of the boards of Nissan and Mitsubishi. The amount Ghosn needs to repay equals the net payments he received from the joint venture between April and November 2018, the court said. Ghosn, who has denied wrongdoing, was chairman of both Nissan and Mitsubishi and chief executive of Renault when he was arrested in Japan in 2018 on charges of underreporting his salary and using company funds for personal purposes. He fled to Lebanon in December 2019 hidden in carry-on luggage on a private jet that flew out of Kansai Airport, and has remained in that country since. Junkyard Gem: 1987 Dodge Ram 50

Chrysler began selling Dodge-badged Mitsubishis way back in the 1971 model year, when the Mitsubishi Colt Galant became known here as the Dodge Colt. Later in the decade, a Plymouth Arrow-badged version of the Mitsubishi Triton small pickup appeared here, along with a Dodge version known as the D-50 and — a few years later — the Ram 50. Once Mitsubishi began selling the same trucks here as Mighty Maxes, starting in the 1983 model year, the Ram 50 didn't seem quite so specialÂ… and then the Dakota made its debut for the 1987 model year. Still, when the Triton went to its second generation that same year, Chrysler continued selling it as the Ram 50. Here's one of those second-generation trucks, found in a Denver-area self-service yard last month. At this point, GM had long since stopped selling Isuzu Fasters with Chevrolet LUV emblems, as had Ford with the Courier-badged Mazda Proceed (after developing the all-American S-10 and Ranger, respectively). The decision-makers at Chrysler, however, calculated that the Ram 50 could grab some sales from Dodge truck shoppers who felt that the Dakota was too big for their needs; as a result, the Ram 50 stayed on sale here through 1994. The last Mighty Maxes rolled out of American Mitsubishi showrooms in 1996. The 6G72 V6 engine became available in four-wheel-drive Ram 50s a few years after this truck was built, but in 1987 all Ram 50s came with either the 2.0-liter 4G63 Sirius or 2.6-liter Astron four-banger. This truck has the base Sirius, rated at 92 horsepower. Remember when new trucks came with double-digit horsepower ratings? Most American-market small pickups still had manual transmissions during the middle 1980s, though that would change in a hurry with the dawn of the 1990s and the drop in slushbox prices. This one has the base five-speed. Just barely 100,000 miles on the clock, very unusual for a junkyard pickup of this age (especially one with a thick coat of brush-applied white house paint on the tailgate). Carlos Ghosn's lawyer requests bail again after Nissan ex-chairman indicted — again

TOKYO — Japanese prosecutors indicted Carlos Ghosn on Monday on another charge of aggravated breach of trust, a Tokyo court said, the fourth charge against the former Nissan Motor Co Ltd chairman, which his lawyers met immediately with a bail request. The charge came on the day Ghosn's latest detention period was set to expire. Ghosn had been out on bail when authorities arrested him for a fourth time on April 4 on suspicion he enriched himself at a cost of $5 million to the automaker. "We are confident that we have the evidence to successfully prosecute all four cases," an official from the prosecutor's office said at a briefing after the indictment was announced. Ghosn has denied all four of the charges, which include understating his income, and said he is the victim of a boardroom coup. He has accused former colleagues of "backstabbing," describing them as selfish rivals bent on derailing a closer alliance between Nissan and its top shareholder, France's Renault SA. "Carlos Ghosn is innocent of the latest charges brought against him by the Tokyo prosecutors, aided and abetted by certain Nissan conspirators," a Ghosn representative said in a statement. The case has exposed tensions in the Nissan-Renault alliance forged by Ghosn some two decades ago when the French automaker invested in Nissan, then on the brink of bankruptcy — a deal that gave Renault control over its larger partner. Nissan is due to reject a management integration proposal from Renault and will instead call for an equal capital relationship, the Nikkei newspaper said on Monday, citing sources. Ghosn's arrest has also focused a harsh light on Japan's judicial system, which critics refer to as "hostage justice" as defendants who deny their charges are often not granted bail. Under Japanese law, prosecutors are able to hold suspects for up to 22 days without charge and interrogate them without their lawyers present. In accordance with these terms, prosecutors had to indict or release Ghosn by Monday. According to the latest indictment, Ghosn caused a total of $5 million in losses to Nissan from July 2017 through July 2018. During that period, prosecutors allege two separate payments of $5 million were made from the account of a Nissan subsidiary into the account of an overseas dealership. A total of $5 million was subsequently transferred from the dealership's account to another account in which Ghosn had an interest.
