Hyundai Kia asked to pay $28.9M in patent infringement case

After years of litigation, Hyundai and Kia have lost their hybrid technology patent infringement case against Paice LLC. The jury ordered the South Korean automakers to pay $28.9 million, but according to Bloomberg, because the violation was allegedly intentional, the judge could triple that amount. The automakers have announced plans to appeal the ruling. Paice's patent dates from 1994 on a piece of tech called the Hyperdrive, and it was a way to seamlessly switch between power from an electric motor and an internal combustion engine. This lawsuit was first filed in 2012 and covered the systems in the Hyundai Sonata Hybrid and Kia Optima Hybrid. According to Bloomberg, the companies tried to argue that the patent was no longer valid, but the strategy failed. "Hyundai strongly believes its position and will appeal any remaining adverse findings to the Federal Circuit," the company said in a statement to Autoblog. Paice is certainly no stranger to litigating over the Hyperdrive patent, though. It and Toyota had a similar court battle that lasted years. Eventually, there was a settlement, and the result was Paice getting royalties for each hybrid that the Japanese automaker sold. Similarly, there's a lawsuit pending against Ford over tech in the C-Max, Fusion, and Lincoln MKZ. Hyundai Statement: Hyundai believes that the verdict returned by the jury today in the matter of Paice v. Hyundai Motor Company et al., is not supported by the evidence. Accordingly, Hyundai has requested that the presiding judge enter a judgment in its favor notwithstanding the verdict. Hyundai strongly believes its position and will appeal any remaining adverse findings to the Federal Circuit.

Lower gas prices mean there are excellent deals on green cars right now

The phenomenon was big enough to make news in 2006, then in 2008, in 2011, in 2012, in 2013, and again last year: a big move in gas prices means a big move in alternative-fuel-vehicle sales. True Car's TrueSavings report, which averages transaction prices across the country to figure out what people are paying compared to MSRP, shows that electric cars and hybrids are ripe for excellent savings right now. The Ford Focus Electric presents the greatest disparity, with the average transaction price of $25,168 representing a 16.1-percent saving off its $29,995 MSRP. The Kia Optima Hybrid and Toyota Prius also snagged spots in the top five, with the Kia offering a 10.7-percent discount and the Toyota a 10.1-percent discount. One hybrid managed to show up among the top five lease offers, too: the Lincoln MKZ Hybrid is just $315 a month for 36 months after $3,875 down in some markets. Alt-energy vehicles got bumped out of the top five finance deals, however. That was dominated by light trucks and, oddly, two subcompacts. The press release below has more details. Guess which brand's not on a top 10 list of best EVs (hint: it's Tesla)

Few surprises lurk in Autotrader’s list of its 10 best electric vehicles of 2023, but there is one that stands out: no Teslas. There's Hyundais and Kias, Porsches and Fords, a BMW and a Nissan. But Â… no Teslas. Although many of us admit to being over-Musked and tired of reading about him, the lack of a Tesla model on a selection of the 10 most desirable current EVs is conspicuous by its absence. Asked about this particular omission, we received this rather vague response from Autotrader spokesperson Brenna Buehler at Cox Automotive: “Tesla models were included in consideration but didnÂ’t get sufficiently high scores by the Editorial team to qualify for the top 10.” At least some Tesla offerings appeared to meet all the requirements set by the website. The manufacturers must offer 2023 model year vehicles, and they have to be sold in at least 15 states. Check. Only pure EVs were allowed on the list; there are no hybrids, plug-in hybrids or hydrogen fuel-cell vehicles. Check. The base manufacturer's suggested retail price must be less than $100,000. Check.
