NHTSA investigates FCA for SUVs that roll out of Park

The National Highway Traffic Safety Administration is opening a preliminary evaluation into the 2014 Dodge Durango and 2014-205 Jeep Grand Cherokee after 14 complaints of the SUVs rolling out of Park. An estimated 408,000 of them could be affected, if a recall is necessary. All of the current complaints submitted to NHTSA about the issue concern the Grand Cherokee, and the claims allege that the SUV can roll out of Park whether or not the engine is running. Some folks report that they check the indicator each time because the gear sometimes fails to engage. Among the 14 cases, there are five accounts of crashes and three injuries, including a situation with someone allegedly being rolled over. NHTSA's preliminary evaluations are meant to investigate "the scope, frequency, and safety-related consequence" of a reported problem. They don't necessarily lead to a recall. The unintended motion has occurred with both the engine off and the engine running. ODI has also identified EWR field report data related to the alleged defect. The model year 2014 and 2015 Jeep Grand Cherokee vehicles are equipped with an electronic gear selector (shift-by-wire system). The gear selection is made by pressing the shifter-paddle forward or backwards; the shifter does not move along a gate path as with conventional gear selectors. A Preliminary Evaluation has been opened to asses the scope, frequency, and safety-related consequence of the alleged defect. I recently spent a week with a 2013 Jeep Wrangler Unlimited Rubicon 4X4. Introduced for the 2007 model year, the Wrangler Unlimited is a standard JK two-door with 20.6 inches added to its wheelbase and two additional doors bolted to its passenger compartment. While Jeep offers the Unlimited in seven different trim levels, the desirable Rubicon is the most capable when the pavement ends, as it boasts a slew of hardcore off-road tools including front and rear electronic locking differentials and a front sway bar that can be disengaged at the touch of a button for improved articulation. My I-Look-Like-A-Traffic-Cone test model started with a base price of $34,095 (plus $995 destination). Options including a five-speed automatic transmission, Uconnect, tow package and a premium soft top, drove the bottom line up to $38,630.

FCA seeking new trial in Jeep fire case, calls $150M judgement 'grossly excessive'

Fiat Chrysler Automobiles is fighting back after a Decatur County, GA jury ordered the company to pay $150 million to the family of a four-year-old boy that was killed after a 1999 Jeep Grand Cherokee crashed and caught fire. The company is requesting the judge reduce the award, and should Walden's family not agree to the lower sum, that a new trial be held. The Detroit Free Press reports that FCA would be forced to pay $120 million over the death of young Remington Walden, with an extra $30 million being paid to the boy's family. Neither figure sits well with the automaker, though, which called the fine "grossly excessive," and claimed it was in violation of Georgia state law. The judgment stems from FCA's long-running problem with the fuel tanks of certain Jeep models built in the 1990s and 2000s. According to the newspaper, FCA argues that the jury was biased after the Waldens' attorneys played on the their passions and pushed for a big award, saying the wrongful death award was 11 times more than any appeals court has ever upheld. FCA said attorneys for the plaintiffs told the jury to base the settlement on Sergio Marchionne's total compensation, $68 million. FCA also claims in its motion that the young boy's suffering was brief. "A $30-million pain-and-suffering award for what plaintiffs acknowledge was at most one minute of suffering is irrational," the motion, which was obtained by The Detroit Free Press, read. "Where such plainly improper arguments are immediately followed by irrational and stunningly excessive damage awards, there can be no doubt that the jury acted from passion and prejudice." Jim Butler, the attorney for the Waldens, has called the motion "nonsense," although he said the family will accept whatever figure the judge sets.
