FCA to appeal reduced judgment in Georgia Jeep case

FCA is appealing the $40 million verdict against it in a case in Georgia where a four-year-old boy died in a fire in a Jeep Grand Cherokee, according to The Detroit News. The jury originally awarded the child's family $150 million, but the judge decided to significantly to reduce the amount based on other precedents. The automaker has been considering further legal options since the decision was announced in July. The boy's death happened in 2012 when he was riding in a Grand Cherokee. The vehicle was rear-ended, and the fuel tank burst, causing a fire. This is the same issue that led to a recall of millions of the SUVs and a recent agreement with the US government from FCA to pay to get them fixed. In the original ruling, the jury said that the automaker was 99 percent responsible for the fatality and didn't adequately warn owners. It asked the company to pay $120 million for wrongful death and $30 million for his pain and suffering. FCA countered that the Jeeps met the safety standards of the time they were made. FCA requested that the jury's award be reduced in May calling the amount "grossly excessive." If the family didn't agree to a lower amount, the company also threatened to seek a new trial. Among the arguments was that $30 million was too much for the child's one minute of suffering. The parents did accept the judge's adjusted figure, though.

Advertisements starring the Oscar winner launched in September, and the results have been impressive. The number of customers clicking on Lincoln.com to check out the MKC – the crossover McConaughey pitched – has tripled since the ads began airing, a spokesman told Autoblog. They also generated 4.4 million views on YouTube and spawned parodies by Ellen DeGeneres, Conan O'Brien, South Park and Jim Carrey on Saturday Night Live, which racked up another 15 million views. Most importantly, Lincoln's sales have increased 15 percent through November, helped significantly by the strong launch of the MKC. Without the addition of the MKC, Lincoln's sales would have been essentially flat last year. The MKC has received solid reviews from consumers and the press, though it has had several recalls. "The overwhelming response to the MKC campaign sparked truly great awareness for Lincoln," Andrew Frick, Lincoln group marketing manager, said in a statement. Now Lincoln has launched another round of spots, which kicked off New Year's Day during college football bowl games. This time, McConaughey is hawking the MKZ sedan and its hybrid sibling. The spots, called Diner and Balance, use the same artistic formula as the earlier ads, with McConaughey intoning seriously about the cars in dramatic settings. They were shot over two days in Los Angeles and were directed by Nicolas Winding Refn, a Danish filmmaker who directed the 2011 move, Drive. The ads continue Lincoln's multiyear deal with McConaughey, who has said he's been long been interested in the brand. He starred in the 2011 thriller, The Lincoln Lawyer, as a defense attorney who worked out of a Town Car, though that was before his deal with Lincoln. In one of the earlier ads, McConaughey claims: "I've been driving a Lincoln since long before anybody paid me to drive one. I didn't do it to be cool. I didn't to it to make a statement. I just liked it." That sentiment appears to have worked for the MKC's launch, and with this new advertising blitz, Lincoln hopes it carries over to the MKZ. Chrysler recalls 468,700 Jeep Grand Cherokees, Commanders over rollaway risk

Chrysler has issued a recall covering a combined 469,000 units of the 2005-2010 Jeep Grand Cherokee and the 2006-2010 Jeep Commander (inset). Of that number, 295,000 are in the US, roughly 33,000 in Canada and Mexico and the remainder in other markets. It seems an electrical fault in the transfer case can allow the affected SUVs to shift into neutral on their own, while an Associated Press report says that Chrysler had "found cracks in a circuit board that turns the four-wheel-drive system on and off." The issue was discovered when an owner started his car remotely and it rolled away.
Chrysler is expected to begin notifying owners in June 2013, who can then take their cars to dealers. The dealer will reflash the final drive controller free of charge. There's a bulletin from the National Highway Traffic Safety Administration below with more information.
