Mahindra fights FCA's Jeep infringement claims

The Indian manufacturer Mahindra is fighting tooth and nail to keep building its Roxor off-road vehicle to sell in the United States. In early August, Jeep mother company FCA filed a complaint with the U.S. International Trade Commission to stop Roxor sales in the U.S. FCA claims the Roxor design is an intellectual property infringement on Jeep design, meant to undercut FCA's own Jeep products on the market. Now Mahindra has released a statement to the commission saying that FCA's complaint is without merit. While FCA stated in its claim that the Roxor is "an imported low-quality knock-off kit car," Mahindra points out that the vehicle took several years to develop and is manufactured in Michigan. Mahindra intends the Roxor to be an off-road vehicle only, and says it does not compete with Jeeps. The Roxor isn't road legal, only comes with a diesel engine and reaches a top speed of only 45 mph. However, it has to be said that the uncomplicated Roxor is far closer to the original ethos of WWII-era Jeeps than the Jeeps FCA currently manufactures. Mahindra also states that FCA agreed in 2009 not to bring about infringement claims as long as Mahindra used a grille design that FCA approved — going with a grille design that clearly differs from the classic Jeep trademark grille. The matter might partially muddled by the fact that the grille agreement was made with 2009's Chrysler instead of today's FCA. Looking back several decades, the entire Mahindra Roxor appearance is at its core based on a 1940s license agreement made with Willys, the original Jeep manufacturer. Mahindra's statement addresses FCA as "Fiat," and it should not be forgotten that Fiat itself manufactured a Jeep lookalike, the Campagnola, from 1951 to 1973 — also with a different grille. Fiat Industrial subsidiary Iveco's history page says the 1951 Campagnola was constructed "according to the Willys mould". Mahindra claims that FCA is using the complaint to create negative publicity to damage Mahindra's reputation. The Indian manufacturer reminds us that it is the first automotive OEM to set up a new manufacturing operation in southeast Michigan in over 25 years — in Auburn Hills, not far from FCA's U.S. headquarters. EPA suspected Fiat Chrysler of using 'defeat device' in 2015

U.S. regulators told Fiat Chrysler Automobiles in November 2015 that they suspected some of the automaker's vehicles were equipped with secret software allowing them to violate emission control standards, according to emails disclosed on Friday. The U.S. Environmental Protection Agency and California Air Resources Board accused Fiat Chrysler in January of using the software, known as a "defeat device," to illegally allow excess diesel emissions in 104,000 Jeep Grand Cherokees and Dodge Ram 1500 trucks built between 2014 and 2016. Byron Bunker, director of the EPA's Transportation and Air Quality compliance division, said in a January 2016 email to Fiat Chrysler, obtained by Reuters under the Freedom of Information Act, that he was "very concerned about the unacceptably slow pace" of the automaker's efforts to explain high nitrogen oxide emissions from some of its vehicles. Nitrogen oxide is linked to smog formation and respiratory problems. Bunker's email said the EPA had told Fiat Chrysler officials at a November 2015 meeting that at least one auxiliary emissions control device on the car maker's vehicles appeared to violate the agency's regulations. Mike Dahl, head of vehicle safety and regulatory compliance for Fiat Chrysler's U.S. unit, responded in a separate email that the company was working diligently and understood the EPA's concerns. He added that if the EPA identified Fiat Chrysler vehicles as containing defeat devices it would result in "potentially significant regulatory and commercial consequences." The documents redacted the vehicles named, but two officials briefed on the matter said they referred to diesel models. The EPA's November 2015 meeting with Fiat Chrysler came two months after Volkswagen AG, mired in a major tailpipe emissions scandal, admitted to installing secret defeat device software in hundreds of thousands of U.S. diesel cars to make them appear cleaner than they were on the road.

Rumor has it the new Grand Wagoneer has been cancelled, but we're not so sure

This just doesn't seem to add up. Autoline Daily is reporting that plans for a new top Jeep, a reimagined Grand Wagoneer to sit above the Grand Cherokee, have been scrapped. The info comes from Auto Forecast Solutions, an industry analyst company. The Grand Wagoneer was expected to use a stretched version of the next Grand Cherokee's platform, but it reportedly won't accept the larger vehicle. The report implies that the next Grand Cherokee will use a version of the current Grand Cherokee's unibody platform, which is about what we expected. The thing is, the current Grand Cherokee shares its platform with the (longer) Dodge Durango, as well as Mercedes-Benz's GLE and GLS SUVs (remember the DaimlerChrysler days?). It's possible the Wagoneer was supposed to be wider as well as longer, and that the Durango's stretch just wasn't enough, but it seems odd that this is just now coming to light. We have already seen sketches of the new Grand Wagoneer, purported to have leaked out of an FCA dealer meeting. Jeep's CEO has discussed the (high) price the new utility would command. It just seems like a lot of thought went into the vehicle already, thought that wouldn't be put forward if someone hadn't looked into the feasibility of actually building it. The report (the one that says the thing has been cancelled) also says FCA might regroup and build the GW as a body-on-frame SUV on the Ram 1500 platform. That also seems unlikely, since this is supposed to be a luxurious, refined vehicle that's nicer than the Grand Cherokee. It would be tough to accomplish all of that with a ladder frame underneath, and it's just not the way the industry is going, let alone the Jeep brand. We'll keep an eye on this one.
