Anton Yelchin's family suing FCA over the actor's death

UPDATE: Anton Yelchin received a recall notification for his Grand Cherokee a week after his death, family attorney Gary Dordick told Variety at a press conference. Dordick called FCA's recall "way too little and way too late." The family of actor Anton Yelchin is suing FCA for negligence and product liability, according to Automotive News. Yelchin was killed in June when his 2015 Jeep Grand Cherokee rolled away, pinning him against a brick pillar and a gate. The Jeep Grand Cherokee, along with 1.1 million other FCA products, is currently under recall for a poorly designed shifter that may lead drivers to believe the car is in park when it isn't. Vehicles affected by the recall are at risk of rolling away. The recall was issued two months before Yelchin's death on June 19. It's believed that this is the first wrongful death lawsuit related to the recall. Although the shifter recall is linked to hundreds of injuries, Yelchin's death is currently the only fatality. There is a class-action lawsuit currently being filed against the automaker. FCA, in a statement to Automotive News, declined to comment and said it had not been served with a lawsuit. Georgia jury awards $150 million in Jeep fire case

FCA US continues to fight allegations that some Jeep Grand Cherokee and Liberty sport-utility vehicles are unsafe because of the possibility of fires in rear-end collisions. In one recently decided case, a jury in Georgia awarded $150 million in damages to a family whose child died in a blaze in 2012 in a 1999 Grand Cherokee. The jury believed that FCA acted with "reckless and wanton disregard," and didn't do enough to warn owners, according to Reuters. The automaker was found liable for 99 percent of the damages, and the remaining one percent was for the driver who rear-ended the family's SUV. In a statement from FCA US, the company said that it is considering an appeal. Under Georgia law, the automaker was allegedly unable to present a three-year investigation of rear-impact data to jurors. This was the same information the National Highway Traffic Safety Administration used to decide that the '99 Grand Cherokee "did not pose an unreasonable risk to motor vehicle safety." The original recall for the models covered 1.56 million examples of the 2002-2007 Liberty and 1993-1998 Grand Cherokee. With the fuel tank located between the rear axle and bumper, NHTSA and FCA eventually agreed to install a trailer hitch for extra protection. A further 1.2 million 1999-2004 Grand Cherokees owners received notice of a customer service action to have their vehicles inspected, though no hitch installed. Subsequent tests showed this remedy to be effective for impacts below 40 miles per hour. The automaker has maintained the SUVs met the applicable safety standards of the period when they were built. The company was chastised by NHTSA last year for low repair rates of the problem. Fiat Chrysler recalls 4.8 million U.S. vehicles for cruise control defect

WASHINGTON - Fiat Chrysler said on Friday it is recalling 4.8 million U.S. vehicles over a defect that could prevent drivers from deactivating cruise control and warned owners not to use the function until they get software upgrades. The Italian-American automaker said no injuries or crashes are related to the large recall campaign but said it had one report of a driver of a 2017 Dodge Journey rental car unable to deactivate the cruise control. Fiat Chrysler, which in 2015 was hit with penalties from U.S. regulators totaling $175 million for safety lapses, did not say how much the recalls would cost. The recall addresses what Fiat Chrysler called an "extremely rare" series of events that could lead to drivers being unable to cancel cruise control. The National Highway Traffic Safety Administration (NHTSA) said on Friday it "strongly encourages vehicle owners to follow a warning" to stop using cruise control on the recalled vehicles until repaired. NHTSA said drivers could overpower the system by forcefully applying the brakes until the vehicle stopped. Fiat Chrysler also said the vehicle could be stopped by shifting into neutral and braking. Fiat Chrysler shares fell more than 2 percent in premarket trading in New York on the recall. Fiat Chrysler noted that at times cruise control systems automatically initiate acceleration to help vehicles maintain driver-selected speeds, including when going up an incline. If an acceleration occurs simultaneously with a short-circuit in a specific electrical network, a driver could be unable to deactivate the function. Fiat Chrysler said vehicles may be placed in park once stopped, at which point cruise-control is canceled. The recall involves a group of gasoline-powered vehicles with automatic transmissions from various model years built from 2014 through the 2019 model year. Most of the vehicles being recalled cover the 2014-2018 model years. Among the vehicles being recalled are the Chrysler 200, Chrysler 300, Chrysler Pacifica, Dodge Charger, Dodge Challenger, Dodge Journey, Dodge Durango, Jeep Cherokee, Jeep Grand Cherokee, Jeep Wrangler and Ram 1500, 2500 and 3500 pickup trucks and Ram 3500/4500/5500 cab chassis trucks. Fiat Chrysler made the announcement going into the busy Memorial Day weekend, which traditionally kicks off the summer driving season.
