NHTSA investigates FCA for SUVs that roll out of Park

The National Highway Traffic Safety Administration is opening a preliminary evaluation into the 2014 Dodge Durango and 2014-205 Jeep Grand Cherokee after 14 complaints of the SUVs rolling out of Park. An estimated 408,000 of them could be affected, if a recall is necessary. All of the current complaints submitted to NHTSA about the issue concern the Grand Cherokee, and the claims allege that the SUV can roll out of Park whether or not the engine is running. Some folks report that they check the indicator each time because the gear sometimes fails to engage. Among the 14 cases, there are five accounts of crashes and three injuries, including a situation with someone allegedly being rolled over. NHTSA's preliminary evaluations are meant to investigate "the scope, frequency, and safety-related consequence" of a reported problem. They don't necessarily lead to a recall. The unintended motion has occurred with both the engine off and the engine running. ODI has also identified EWR field report data related to the alleged defect. The model year 2014 and 2015 Jeep Grand Cherokee vehicles are equipped with an electronic gear selector (shift-by-wire system). The gear selection is made by pressing the shifter-paddle forward or backwards; the shifter does not move along a gate path as with conventional gear selectors. A Preliminary Evaluation has been opened to asses the scope, frequency, and safety-related consequence of the alleged defect. Ram and Jeep diesel emissions allegations spur class action lawsuits

This shouldn't come as a surprise. Last week, the EPA issued a notice of violation to FCA after it determined that Jeep and Ram installed eight undisclosed auxiliary emissions control devices on diesel vehicles. Since then US law firm Heninger Garrison Davis, LLC and Canadian firm Sotos LLP have launched class action suits on behalf of owners. These latest lawsuits are unrelated to a previous class action suit brought against FCA and Cummins over NOx emissions in 2007 to 2012 Ram models. The violation notice – and the subsequent lawsuits – covers 2014 to 2016 Jeep Grand Cherokee and Ram 1500 models equipped with the 3.0-liter turbodiesel V6, a total of about 104,000 vehicles in the US. The EPA says that while the emissions control devices aren't necessarily illegal, installing them without disclosing them to the EPA is, as they produce more emissions in real world use than in testing. Skirting certification in this way might be a violation of the Clean Air Act. FCA could see fines of up to $45,000 per vehicle, depending on the outcome of the EPA investigation. FCA denies that these are cheat devices, and has proposed software updates to bring the vehicles into compliance. As for the lawsuits, Heninger Garrison Davis says that "Fiat Chrysler marketed those vehicles as environmentally friendly with enhanced fuel efficiency, better performance, and lower emissions. Although the diesel vehicles were successfully marketed as 'clean,' their environmentally-friendly representations were deceptive to consumers." The suit seeks an undisclosed amount of compensation for owners of these vehicles. In Canada, Sotos LLP is seeking $250 million in damages on behalf of owners. This suit, filed in the Ontario Superior Court of Justice, also claims deception on the part of FCA, "resulting in losses and damage" to owners. These are similar claims to group actions against Volkswagen with regard to its diesel emissions cheating scandal. While VW is fixing or buying back many of the affected vehicles, the company is defending itself against some suits on behalf of owners, saying it expects " no decline in the residual values of the affected vehicles as a result of this issue." Don't be surprised if FCA mounts a similar defense.

We just finished a one-year test of a 2014 Jeep Cherokee Trailhawk, and after 27,000 miles of hard use, one thing is very clear: this is one of the best all-rounders we've ever tested. The Jeep Cherokee isn't perfect, and our long-term tester proved that. But no compact crossover is. Still, the Trailhawk oozed personality where other small CUVs seem bland, and the Jeep felt more like a trusty companion than just another test car. For road trips, the requests weren't, "Can I have a long-term car this weekend?" They were specific: "I'd like the Cherokee, please." No matter the season, the driver, or the situation, the Jeep was always a sure fit. Fiat Chrysler bet big with this one. It had a global platform, a new engine, and one heck of a funny face. The end result was a CUV that we'd gladly welcome back into our fleet any day. To this day, many of us still think the Cherokee is a homely little thing, but its inherent weirdness doesn't stand out as much when you add the black accents and big, knobby tires of the Trailhawk model. The butched-up look really works here, and we wouldn't have wanted the Jeep any other way. Of course, opting for Trailhawk package meant getting one of Jeep's more expensive Cherokees. Our car carried a sticker price of $38,059, but that's without goodies like HID headlamps (which we could have used – the halogens were pretty weak), a sunroof, or even full leather seats. This car genuinely felt premium, though. Right off the bat, the Cherokee received compliments for its comfortable, supportive seats, not to mention the high quality of interior materials and the general fit and finish. Specifically, the interior packaging won us over early on. We appreciated things like the higher-end stereo, smart layout of the center console, and ample storage, including a bin under the front passenger seat cushion. (That said, we also found that this bin becomes a catch-all for wrappers, french fries, and anything else that might get dropped on the seat.) The Uconnect infotainment system was a joy to use, never giving us any finicky problems or usability issues.
