Hyundai finally settles inflated fuel economy claims lawsuit for $41.2 million

Remember when Hyundai and Kia changed their claimed fuel economy numbers for a bunch of models? That happened back in 2012, and Hyundai has finally settled a lawsuit concerning the economy adjustment with a payment of $41.2 million. The lawsuit was filed by 33 state attorneys general, as well as one from Washington D.C. Each state will decide how to use its money from the settlement. According to Hyundai, this settlement was an "amicable agreement," and the company also denies any wrongdoing in changing claimed fuel economy numbers. Hyundai also reports that the agreement was reached, in part, due to the reimbursement program instituted after the economy adjustment. This program allows owners to be reimbursed the extra fuel cost, with payments determined by miles driven. The payments are sent after an owner has an affected car's odometer checked by a dealer. In addition, Hyundai also offered lump-sum payments as an option after the results of a class-action lawsuit. So far, the company reports about 75 percent of eligible owners have participated in the program. This isn't the only major payment Hyundai has made concerning the fuel economy issue. In 2014, Hyundai paid roughly $300 million in fines to the EPA. The company was also sued for inflated fuel economy claims in South Korea. In the US, models affected by the adjustment include the Hyundai Santa Fe, Accent, Veloster, Sonata Hybrid, Tucson, Genesis and Azera, along with the Kia Soul, Rio, Sorento, Sportage and Optima. Hyundai i20 gets Active for Frankfurt

Hyundai has a raft of new debuts to showcase at the Frankfurt Motor Show this month, and what's caught our eye here is the new i20 Active. It's a more rugged version of the supermini hatchback that replaced the Getz in 2008. Now in its second generation, the i20 is already offered in three- and five-door guises, and is now expanding even further with the introduction of this pseudo-crossover soft-roader. The new Hyundai i20 Active is based on the five-door model, but offers the better part of an inch more ground clearance thanks to a revised suspension. It also benefits from skid plates under the front and back, beefed-up wheel arches, and a higher seating position. All of which promise to make the little hatchback feel just a little bit better prepared to venture off the beaten path – or at least the smooth pavement. European buyers will be able to choose between a 1.0-liter turbocharged three-cylinder engine in two states of tune that will now be introduced across the i20 range. The more efficient of the two produces 99 horsepower, while a slightly more potent version offers 118 hp. The new i20 Active will be featured on Hyundai's show stand alongside the new Santa Fe, the Vision G concept we saw in Monterey, and the N 2025 Vision Gran Turismo concept that's slated to launch the company's new N performance sub-brand. Who can really claim first mass-produced fuel cell vehicle delivery in US?

Last month, Hyundai said that the initial deliveries of the Tucson Fuel Cell vehicles in California meant that, "For the first time, retail consumers can now put a mass-produced, federally-certified hydrogen fuel cell vehicle in their driveways." But try telling that to Jon Spallino. In 2005, Honda leased a hydrogen fuel cell FCX, a small hatchback, to the Spallino family (as far as we know, he parked it in his driveway). The company did the same thing again in 2008 with the FCX Clarity, a sleek new design based on the FCX Concept, and others signed for the H2 ride as well, including celebrities. No matter how you slice it, Honda has been in the fuel cell delivery market for almost a decade now. Just look at this. Or this. Or this. Oh, and other automakers (General Motors in Project Driveway in 2006 and Mercdes-Benz with the F-Cell in 2010, for example) have delivered fuel cell vehicles in the US as part of short-term test programs. But let's get back to Hyundai's claim. There's little question that the first delivery of a "fuel cell vehicle for the US market" has already taken place (and they were federally certified, too), which means that the debate revolves around the definition of mass-produced and whether "mass production" is about a number or about the process? Let's investigate below. First, lets review Honda's bona fides. We can start with the official version of Honda's fuel cell history, which is missing the pertinent detail that Honda build the Clarity on a dedicated assembly line and established a small network of three dealerships to lease the FCX Clarity in 2008. All of the FCX Clarity vehicles in customer hands in the US were leased through these dealerships. Sure, Honda started with hand-built stacks in its hydrogen vehicles, but went to automated control of some parts and components with series production. "It is good to see others doing today what we've been doing since 2008" – Steve Ellis, Honda Or, as Honda's Steve Elllis put it to AutoblogGreen regarding Hyundai's fuel cell deliveries: "This was exactly as prescribed by the creation of the California Fuel Cell Partnership. It's the very essence of 'co-op-itition.' We at Honda, as do many others, continue to push forward on many technologies, both the battery and the fuel cell. And society is the beneficiary." Then he added, "It is good to see others doing today what we've been doing since 2008." Now, how does Hyundai compare?
