Hyundai To Fight $248 Million Judgment Over Fatal Montana Crash

A Montana jury has levied a $248 million ruling against Hyundai in the case of a crash that killed two occupants in July 2011. The automaker plans to appeal the ruling. Cousins Trevor and Tanner Olson were driving a 2005 Hyundai Tiburon when they hit another vehicle head-on. According to lawyers representing their family, the steering knuckle on the car cracked and this allegedly caused it to lose control. Hyundai claimed that fireworks had been let off inside the vehicle, which caused the driver to swerve. The company alleges that evidence that could have proved its innocence was barred from the case. The jury found in favor of the family and awarded them about $8 million in damages after a two-week trial. It claimed that Hyundai had shown "actual malice," according to Reuters. The jurors also slammed Hyundai with a further $240 million in punitive damages. Hyundai told Reuters that it plans to appeal immediately and called the verdict "outrageous." Statement by Hyundai Motor America While a tragic accident, Hyundai firmly believes the jury's verdict in Olson vs. Hyundai is mistaken and award of damages at three times what was sought by the plaintiffs is outrageous and should be overturned as Hyundai is not at fault. Eyewitness testimony established – and experts for both sides agree – that fireworks exploded in the unbelted teenagers' vehicle immediately before the July 2, 2011 accident, which involved the driver losing control, crossing the median and crashing head-on into an oncoming Pontiac at a closing speed of approximately 140 miles per hour – a speed confirmed by experts for both sides. Hyundai believes the jury's view of the evidence was distorted by a series of erroneous rulings by the Court, the most egregious of which prevented the jury from reviewing performance testing conducted by renowned failure analysis experts that would have disproven the plaintiffs' theory of the case – a theory derived by a local resident with no previous automotive experience. Hyundai will seek an immediate appeal. Here at Autoblog, we love unexpected debuts at auto shows – and judging by our Detroit Auto Show comments and traffic, you do, too. Surprise reveals have been fewer and farther between in recent years with so many ways for vehicles to be teased or leak out, but this week's show has been a revelation. More to the point, it's been a series of revelations, with automakers from around the globe successfully delivering a brace of concept and production surprises. It's made our jobs a lot more exciting and challenging this week, and even though it's actually more work to react and run-and-gun when the sheet is pulled on a surprise reveal than it is to publish an already-written embargoed story, we've had more fun covering this show for you than any domestic show in memory. We hope you've enjoyed the surprises along with us. 2015 Hyundai Tucson Fuel Cell

Hyundai leased its first Tucson Fuel Cell crossover last week, which the automaker claims makes it the first mass-produced fuel cell vehicle (FCV) that has been offered to the public (Honda may have something to say about that...). The vehicle, which consumes hydrogen and emits only clean water vapor from its exhaust pipe, will initially only be offered for lease in Los Angeles and Orange Counties - two regions with the greatest density of approved hydrogen stations in the country - at a monthly fee of $499. Since the Tucson FCV rolls down the same Ulsan, Korea, production line as its gasoline-powered relative, production is scalable based on customer demand.
We attended the festivities with the dignitaries and elected officials - clapping until our hands hurt. But once it was over, we grabbed a set of keys and took the new FCV for a half-hour jaunt. According to the press materials, written with a welcomed sense of humor, Hyundai will offer it in three colors: white, white and optional white. Our test model was the latter.
