Hyundai To Fight $248 Million Judgment Over Fatal Montana Crash
Fri, May 16 2014A Montana jury has levied a $248 million ruling against Hyundai in the case of a crash that killed two occupants in July 2011. The automaker plans to appeal the ruling. Cousins Trevor and Tanner Olson were driving a 2005 Hyundai Tiburon when they hit another vehicle head-on. According to lawyers representing their family, the steering knuckle on the car cracked and this allegedly caused it to lose control. Hyundai claimed that fireworks had been let off inside the vehicle, which caused the driver to swerve. The company alleges that evidence that could have proved its innocence was barred from the case. The jury found in favor of the family and awarded them about $8 million in damages after a two-week trial. It claimed that Hyundai had shown "actual malice," according to Reuters. The jurors also slammed Hyundai with a further $240 million in punitive damages. Hyundai told Reuters that it plans to appeal immediately and called the verdict "outrageous." Statement by Hyundai Motor America While a tragic accident, Hyundai firmly believes the jury's verdict in Olson vs. Hyundai is mistaken and award of damages at three times what was sought by the plaintiffs is outrageous and should be overturned as Hyundai is not at fault. Eyewitness testimony established – and experts for both sides agree – that fireworks exploded in the unbelted teenagers' vehicle immediately before the July 2, 2011 accident, which involved the driver losing control, crossing the median and crashing head-on into an oncoming Pontiac at a closing speed of approximately 140 miles per hour – a speed confirmed by experts for both sides. Hyundai believes the jury's view of the evidence was distorted by a series of erroneous rulings by the Court, the most egregious of which prevented the jury from reviewing performance testing conducted by renowned failure analysis experts that would have disproven the plaintiffs' theory of the case – a theory derived by a local resident with no previous automotive experience. Hyundai will seek an immediate appeal. The Japanese carmarker was looking for a way to profit from loyal Honda owners wanting to move upscale, but not willing to move out of Honda's orbit. The launch of Acura and two models – the upscale Legend and accessible Integra – did the trick. In the past five years, Korean carmaker Hyundai has been attempting to make its own move upmarket with its Genesis sedan and, more recently, the Genesis brand. In 2012, it was the Genesis coupe and 4-door; the coupe enjoyed an Infiniti-like vibe, while the sedan had a whiff of Mercedes in its sheetmetal and value in its window sticker. Available with V6 or V8 power and prices in the low $40s to low $50s, the Genesis four-door represented bargain luxury in an America gripped by recession. Today, a pre-owned Genesis, like our example here, extends the value argument. If this Genesis has a V8, the price point is spot-on for an example in excellent condition. Hyundai recalls 10k Genesis Coupes for detached driveshafts
Sun, Dec 13 2015Hyundai has issued a recall for 10,800 examples of the Genesis Coupe. The problem with vehicles affected rests with the differential, which may have been misaligned with the crossmember of the rear suspension. In such a case, the bolts securing the differential may loosen, and could lead to the driveshaft disconnecting entirely, resulting in the complete loss of propulsion. The recall specifically affects certain models manufactured between December 28, 2011, and April 6, 2015. The problem is only with those units fitted with the six-speed manual transmission and not the eight-speed automatic. To address the problem, owners will be asked to bring their Genesis Coupes in to their local dealer to "verify the proper assembly of the differential." The Genesis Coupe was first introduced in its home market back in 2008, and arrived in North America the following year as a 2010 model. The most recent revision happened in 2013 – the model year with which this recall begins. A completely new model is expected to arrive soon as part of the new Genesis luxury sub-brand's lineup. In the affected vehicles, if the differential and the suspension rear crossmember were not properly aligned during vehicle assembly, the bolts that secure the differential may loosen. CONSEQUENCE: If the rear differential loosens from its mounting position, the driveshaft may disconnect from the differential, resulting in a loss of propulsion and an increased risk of a crash. REMEDY: Hyundai will notify owners, and dealers will verify the proper assembly of the differential, free of charge. The recall is expected to begin on January 11, 2016.
