U.S. appeals court preserves $210M Hyundai-Kia fuel economy class settlement

A U.S. appeals court restored a $210 million nationwide class-action settlement for hundreds of thousands of owners of Hyundai Motor Co and Kia Motors Corp vehicles whose fuel economy estimates were inflated. By an 8-3 vote on Thursday, in a case closely watched by class-action lawyers, the 9th U.S. Circuit Court of Appeals in Pasadena, California, said vehicle owners had enough in common to let them settle as a group. It also rejected arguments by owners opposed to the settlement that the claims process was too burdensome, and that lawyers for the class had colluded with the automakers to extract a "sweetheart deal" that undervalued their claims. The case began after the U.S. Environmental Protection Agency found flaws in Hyundai's and Kia's testing procedures, prompting the automakers to lower fuel efficiency estimates for about 900,000 vehicles from the 2011, 2012 and 2013 model years. Lawyers for objecting drivers had no immediate comment. Hyundai said it was grateful for the decision. Kia and its lawyers did not immediately respond to requests for comment. The decision by Circuit Judge Jacqueline Nguyen upheld a settlement approved in June 2015 by U.S. District Judge George Wu in Los Angeles. Wu "made careful findings, which the objectors here largely do not challenge, and which more than support the judgment," Nguyen wrote. The decision reversed a divided three-judge 9th Circuit panel's January 2018 rejection of the settlement and decertification of the class action. That panel said Wu failed to assess whether differences in state laws prevented certification of a nationwide class. It also said used car owners should have been excluded because it was unclear whether they had relied on the South Korean automakers' fuel economy claims. Lawyers had said it would become much harder to obtain nationwide settlements if the panel ruling stood. Nguyen had dissented from the panel ruling. Circuit Judge Sandra Ikuta, who wrote it, dissented on Thursday. Ikuta accused the majority of failing to determine what law should apply to the nationwide class or how the settlement, and thus attorneys' fees, should be valued. "The majority's failure to correct these errors may be beneficial for the class action bar, but it detracts from compliance with Supreme Court precedent," Ikuta wrote. The 9th Circuit covers nine western U.S. states, Guam and the Northern Mariana Islands.

Hyundai reveals new Creta crossover in India

It's been less than a month since Hyundai told us to start anticipating the arrival of the new Creta, and even less time since it released the first teaser sketch. Now the Korean automaker has taken the wraps off the finished product. Unveiled over the weekend in India, the new Hyundai Creta applies the company's latest design language to a smaller crossover form. Full details have still yet to be released, but those body panels are laid over a structure the manufacturer calls Hive. It makes use of a high proportion of high-strength steel to keep the chassis rigid yet lightweight. Powertrain options – for the Indian market anyway – include a 1.6-liter four with 121 horsepower or a choice of diesels with as much as 126 hp. Hardly earth-shattering stuff, but short of more potent turbocharged offerings, those engines ought to make it perfectly competitive with the company it intends to keep. Relative output and fuel choices aside, the engines channel their power through a six-speed manual or automatic transmission, though there's no mention as of yet of the availability of all-wheel drive. We'll have to wait for a release with a wider purview to find out more. At this point Hyundai isn't showing us around the interior, either, but you can scope out what images have been released thus far in the slideshow above. It'll be a while longer before anyone can determine whether it'll prove a worthwhile competitor to the likes of the Nissan Juke, Jeep Renegade, and Honda HR-V, to name just a few likely rivals. With fellow Korean automaker SsangYong eager to make its mark with the similarly compact Tivoli as well, the Creta will have quite a fight on its hands. You can now Uber a Ford F-150 for tailgating at NFL games

The Ford F-Series has been named as the official truck of the NFL, whatever that means. To kick things off, the automaker is giving fans in New York the ability to order a "Built Ford Tough Tailgate Truck" on demand through Uber. The NFL-backed tailgate F-Series trucks will bring fans tailgate food, tickets, and merchandise. The ability to get a tailgate truck through Uber is currently limited to New York, but Ford will also offer a tailgate tour in various cities where NFL fans can win tailgate parties, tickets to games, and access to their own Ford tailgate truck. The sponsorship is for three years and includes America's best-selling truck, the Ford F-150, along with the automaker's Super Duty trucks. Ford is also giving NFL fans the ability to enter the "Built Ford Tough Toughest Ticket" sweepstakes for a chance to win Super Bowl LI tickets, along with a new 2017 Ford F-Series Super Duty decked out to showcase the winner's favorite football team. The NFL has partnered with various automakers in the past, with the most recent being a four-year deal with Hyundai in 2015. The Korean automaker is currently the official car, SUV, and luxury vehicle of the NFL, which conveniently leaves a spot for Ford's F-Series trucks to slot into. Hyundai took the sponsorship from General Motors, which had been a sponsor since 2001. Ford's new sponsorship comes at the perfect time as the new season official starts tomorrow with the Carolina Panthers taking on the Denver Broncos.
