By BIDDING ON THE VEHICLE, “YOU understand, acknowledge and agree to the following TERMS:

As consideration for its receipt of the Surplus Property, the Recipient, on behalf of itself and the Recipient Releasors, hereby releases, waives, discharges, and covenants not to sue the City Releasees from and for any and all liability for any loss or damage to the Recipient, the Recipient Releasors, the Surplus Property or any other property or person, including third parties, and from and for any claims or demands related to any loss, damage, cost or injury, including wrongful death, to any property or persons, including without limitation the person or property of the Recipient, the Recipient Releasors or any other person or third party, whether directly or indirectly caused by any known or unknown act, omission or willful conduct of the Recipient, the Recipient Releasors, the City, the City Releasees, or any other person or third party which is in any way related to the receipt, use, maintenance or ownership of the Surplus Property.

 

AS CONSIDERATION FOR ITS RECEIPT OF THE SURPLUS PROPERTY, THE RECIPIENT, ON BEHALF OF ITSELF AND THE RECIPIENT RELEASORS, HEREBY ACCEPTS ALL RISKS (KNOWN OR UNKNOWN) which are in any way related to the receipt, use, maintenance or ownership of the Surplus Property. 

 

THE RECIPIENT, ON BEHALF OF ITSELF AND THE RECIPIENT RELEASORS, ACKNOWLEDGES that all warranties which may have existed for the Surplus Property, including, but not limited to, the manufacturer’s warranty, may have expired or may not be transferable to Recipient, and that the City makes no representation, warranty, guarantee or pledge that any such warranties have not expired or may be transferable to, or usable by, Recipient. 

 

THE RECIPIENT, ON BEHALF OF ITSELF AND THE RECIPIENT RELEASORS, ACKNOWLEDGES that the Surplus Property has deteriorated over time, that the Recipient accepts the Surplus Property as-is and with all risks inherent in the receipt, use, maintenance or ownership of the Surplus Property, and that the City makes no representation, warranty, guarantee or pledge that the Surplus Property will be effective, safe or useful in any way. 

 

AS CONSIDERATION FOR ITS RECEIPT OF THE SURPLUS PROPERTY, THE RECIPIENT, ON BEHALF OF ITSELF AND THE RECIPIENT RELEASORS, HEREBY AGREES TO DEFEND, INDEMNIFY AND SAVE AND HOLD FREE AND HARMLESS City Releasees from any and all liability from loss, damage, cost or injury, including wrongful death, to any property or persons, including third parties, in any manner arising out of or incident to any acts, omissions or willful misconduct in any way related to the receipt, use, maintenance or ownership of the Surplus Property, including without limitation the payment of attorneys' fees.  The Recipient shall defend at its own expense, including attorneys' fees, the City Releasees in any action or proceeding, legal, administrative or otherwise, based upon such acts, omissions or willful misconduct.

 

THE RECIPIENT, ON BEHALF OF ITSELF AND THE RECIPIENT RELEASORS, ACKNOWLEDGES that these TERMS are intended to be, and shall be, interpreted and applied as broad and inclusive as is permitted by federal, state and local laws, rules and regulations, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. 

 

THE RECIPIENT REPRESENTATIVE REPRESENTS that he or she is age eighteen (18) or older, has the full power and authority to execute these TERMS on behalf of the Recipient and to thereby bind the Recipient as provided for herein, and that all procedural or substantive steps necessary to obtain the authorization of the governing board of the Recipient have lawfully occurred. 

 

THE RECIPIENT REPRESENTATIVE HAS READ, UNDERSTANDS AND VOLUNTARILY AGREES TO THE CONDITIONS STATED, and makes the following additional representations: (1) these TERMS shall be binding upon the Recipient Representative, the Recipient and the Recipient Releasors; (2) valuable legal rights are being given up by executing these TERMS; (3) the advice of an attorney can be sought before executing these TERMS; and (4) these TERMS are agreed upon  of free will and no written or oral representations, statements or inducements, apart from the foregoing written provisions, have been made to induce Recipient Representative to execute these TERMS. RECIPIENTS REPRESENTATIVE must provide a printed original copy of the signed TERMS forms (as provided by the City of Corona) upon pick up of the vehicle.

Roush getting back into sport compact business with Focus ST mods [w/video]

Roush Performance offers a whole raft of parts for folks looking to tune their Ford Mustang and F-150 models, and now Focus owners can start getting in on the hotted-up action, too. Owners of the 2012-13 Focus and 2013 Focus ST can now get a Roush cold-air intake system, and ST owners can also opt for a high-performance cat-back exhaust.
Although all of these components are now available for order, the parts will ship sometime in July; no word yet on pricing. Down the road, Roush will also offer styling upgrades for the Focus as well as performance tuning upgrades such as engine controller, suspension, wheels and tires. Ford, Chrysler and Mazda expand scope of Takata airbag recalls

The scope of the Takata airbag inflator recall is ballooning once again across the United States. Where Honda has elected to take its driver-side airbag campaign nationwide, Chrysler Group and Ford have now announced expanded regional actions to cover some passenger-side airbag inflators. Mazda is adding more regions, as well. For Chrysler Group, the campaign covers the inflators on 149,150 examples of the 2003-model-year Ram 1500, 2500 and 3500 pickups. The recall is limited to vehicles sold or ever registered in Alabama, Florida, Georgia, Hawaii, Louisiana, Mississippi, Texas and the territories of American Samoa, Guam, Puerto Rico, Saipan, and the Virgin Islands. The company will begin notifying affected customers on January 19. According to Chrysler's announcement of the action, the passenger side inflators in these trucks "are of a type that is not used in any of the other vehicles affected by Chrysler Group's regional field action." The automaker says that it's not aware of any actual failures or accidents in these pickups and even claims there are no "observed failures in laboratory testing of its airbag modules." The company is continuing to study the problem, though. Ford is taking a similar step by issuing a recall of inflators for 38,500 examples of the 2004-2005 Ranger and 2005-2006 Ford GT. The campaign only affects vehicles originally sold or ever registered in Florida, Hawaii, Puerto Rico and the US Virgin Islands. Certain zip codes of Georgia, Alabama, Mississippi, Louisiana, Texas, Guam, Saipan and American Samoa are also covered. There's already precedent for passenger-side airbags to be covered under the Takata inflator recall. When many automakers announced campaigns in June, BMW, Chrysler, Ford, Honda, Mazda, Nissan and Toyota all included that side in some of their repairs. Subaru subsequently did, as well. In addition, Mazda is expanding the scope of its recall to add Florida, Puerto Rico, Hawaii, Saipan, Guam, American Samoa, US Virgin Islands, Georgia, Alabama, Louisiana, Mississippi and Texas to the affected areas. The company estimates that it has a total of 86,773 vehicles in need of repair. Mazda is also teaming with Toyota to begin independent testing of the Takata inflators. Lincoln MKC recalled because start button located too close to touchscreen [UPDATE]

UPDATE: Ford spokesperson Kelli Felker responded to our questions and let us know that the fix for the push-button start on the 2015 MKC has the switch moved to the top of the of the column of gear shift buttons instead of the bottom. Owners should be notified about both campaigns "toward the end of February." After massive campaigns from General Motors and to fix Takata airbag inflators, 2014 will undoubtedly go down as The Year Of The Recall. And with little time to spare, Ford is getting in just under the wire to adding two more to its yearly total. The larger of the campaigns is actually one of the most bizarre campaigns we've heard of all year. Lincoln is recalling 13,574 units of its 2015 MKC compact crossover in North America to move the location of the push-button ignition switch on the dashboard. According to the automaker's announcement: "Due to the switch's close proximity to other controls, occupants are inadvertently shutting off the engine while driving." The button is located near the bottom of the touchscreen, which can apparently make it possible to hit by mistake. Back when Autoblog first drove the new MKC in June, we came away very impressed, but noted: "... we're still not completely sold on the aforementioned pushbutton transmission selector ... it still seems somewhat gimmicky and it can't be operated by feel alone, as you might when shifting a traditional console-mounted lever from Park to Drive." According to Lincoln, there have been no reported accidents or injuries stemming from this button misapplication. Of the affected vehicles, there are 11,144 in the US, 2,033 in Canada and 397 in Mexico. To fix the problem, dealers are moving the button to a different location and reprogramming the powertrain control module. According to Automotive News, models built since September already have a different layout. The change was reportedly done to match the rest of the Lincoln lineup. The second recall covers 12,205 units of the 2014 Ford Escape (2015 model year pictured below) and 2015 Lincoln MKC in North America because of a problem with nickel plating on the fuel pump. The issue can cause the pump to seize, which can cause the crossovers not to start or stall while driving. The automaker is not aware of any accidents or injuries related to this fault. Dealers are replacing the fuel deliver module to fix the situation. Of the affected vehicles, there are 9,038 in the US, 3,074 in Canada and 93 in Mexico.
