Weekly Recap: Auto execs face life in prison for recall delays under proposed legislation

The stiff punishments are part of broader transportation legislation, but clearly McCaskill has automakers in her sights.
Missouri Senator Claire McCaskill threw down the gauntlet this week, proposing a bill that could send auto executives to prison for life if they were found to have delayed a recall. She also wants to eliminate the limit for fines for auto safety violations, which are currently capped at $35 million.

In 1963, real estate agent Arthur Lampitt was driving a new Ford Thunderbird near East Peoria, Illinois on his way to an appointment when he collided head-on with a truck. A massive accident that was so bad that it was originally reported as a fatal crash, Lampitt suffered a broken hip and that became the focus of doctors' efforts. In fact, no one noticed the fact that the turn-signal stalk had been broken off the steering column and had lodged itself in Lampitt's arm. Fast-forward to around ten years ago, when Lampitt set off a courthouse metal detector because of a "slender object, about the size of a pencil" in his arm. Despite that unnerving discovery, the doctor who examined Lampitt said that since it didn't hurt, he needn't worry about it. This year, however, it did start hurting and the affected arm started to bulge. Lampitt decided to have the issue seen to, and suspected it might have something to do with his 1963 accident. When he looked through photos of the wreck taken by a friend, he noticed the turn-signal stalk of the Thunderbird missing and figured that was the culprit. After a 45-minute outpatient surgery, the surgeon verified it: a slim, slightly bent and corroded, seven-inch metal cylinder with a trumpeted end. The surgeon said a protective pocket had formed around it, which is why it could remain in Lampitt's arm so long, but it was still unusual - "We see all kinds of foreign objects like nails or pellets, but usually not this large." Lampitt, who is expected to make a full recovery, says he might make a keychain out of it, once he's done just holding it. Again? Ford issues second 2015 Fusion and Lincoln MKZ seat belt recall

In 2016, Ford issued a recall for 603,392 2013-2016 Fusions and 2013-2015 Lincoln MKZs due to potentially faulty seat belts. Apparently, that wasn't the end of it. Ford announced another recall this week for the same issue, this time covering 108,399 2015 Fusions and MKZs.  In both cases, the seat belt anchor pretensioners are the issue. According to Ford, "increased temperatures generated during deployment of the driver or front-passenger seat belt anchor pretensioner could degrade the tensile strength of the cable below the level needed to restrain an occupant." Basically, heat could weaken the seat belts, and in extreme cases, they wouldn't be able to keep up proper safety standards. Ford knows of at least one injury that has occurred due to this issue.   The recall includes 103,374 vehicles in the United States, 4,002 in Canada, and 1,023 in Mexico. Possibly affected Fusions were built at Ford's Flat Rock Assembly Plant between August 1, 2014 and January 30, 2015. The MKZs were built at the Hermosillo Assembly Plant between August 1, 2014 and November 21, 2014.  As a fix, Ford says dealers will add an extra coating to the seat belt pretensioner cable for protection from the heat. If this recall might affect your vehicle, call your local Ford dealership and use recall reference No. 19S25. This news comes after Ford recalled 1.3 million Fusions and MKZs in 2018 due to the possibility that the steering wheels could fall off. Fusions have also been recalled due to the risk of rolling away.
