Ford faces class-action lawsuit for selling vehicles without brake override systems

A total of 20 Ford customers are suing the automaker in a class-action lawsuit for selling vehicles "vulnerable to unintended acceleration." According to Reuters, the suit names 30 models built between 2002 and 2010 with electronic throttle control systems but without a brake override system. Those include the 2004-2012 F-Series pickups and the 2005-2009 Lincoln Town Car. Adam Levitt, a partner with the law firm of Grant & Eisenhofer says the plaintiffs in the case want "to be compensated for their economic losses by having overpaid for cars that contained defects." Levitt contends that the plaintiffs would not have bought their vehicles or paid less for them had they known there was no brake override system in place.
Ford began installing brake override systems in its vehicles beginning in 2010. In response to the lawsuit, Ford has pointed to research by the National Highway Traffic Safety Administration that indicated that unintended acceleration is mostly caused by driver error, saying in a statement that, "NHTSA's work is far more scientific and trustworthy than work done by personal injury lawyers and their paid experts."
Belville et al v. Ford Motor Co. will be heard in US District Court in the Southern District of West Virginia.

Ford nets $5.7B in 2012, $1.6B in fourth quarter

Ford brought in $5.7 billion in net income during 2012, which is around $307 million less than one year prior. Even so, the automaker closed out 2012 with the highest pre-tax profit for a single quarter in nearly 10 years, earning $1.7 billion in the fourth quarter thanks largely to a higher-than-average truck mix in the US. That's a jump of $577 million over 2011. Likewise, that translated into fourth quarter income of $1.6 billion. All told, Ford set a full-year pre-tax profit record in 2012. But that doesn't necessarily mean everything is rosy in the land of the Blue Oval.
Like every other manufacturer, 2012 saw Ford get hammered in the European Union, where a deep economic recession continues to drive down consumer confidence. The automaker lost more than $700 million in Europe, and saw full revenue of $26.6 billion in 2012. That's a decline of $7.2 billion compared to last yea. BMW is testing AdBlue pumps in Germany. AdBlue fluid is used to remove NOx from diesel exhaust, and it is stored in its own tank within the vehicle. Filling AdBlue is easy enough for drivers to do it themselves, and with the proliferation of diesel vehicles in Europe, a pump filling system could make more sense than using the current hand-held containers. BMW is testing AdBlue pumps at three fueling stations in Munich and Berlin to help develop further AdBlue dispenser technology. Read more at Green Car Congress. Drivr Green Personal Transportation is a Tesla taxi service in Cincinnati. Two former employees of Tesla Motors founded the startup, which bills itself alongside ride-hailing services like Uber and Lyft. Customers book a ride online, and are picked up by a Tesla Model S. The ride costs $2.50 per mile with a $15 minimum. Drivr currently operates three cars with seven drivers, with plans to lease another 10 Teslas and employ up to 30 drivers. Ford is opening a research and development facility in Silicon Valley. The Ford Research & Innovation Center, which will be located less than three miles from Tesla Motors headquarters in Palo Alto, California, is expected to be one of the automotive industry's largest R&D facilities. Law firms advising Fisker Automotive have been denied a $2.50-million fee enhancement in the car company's bankruptcy. Brown Rudnick LLP and Saul Ewing LLP were denied the extra fees, as a Delaware bankruptcy judge ruled there is "no evidence" that the firms provided anything more than what they originally expected.
