Automakers tussle over owners of 'orphan' makes

When General Motors put down several of its brands in recent years, it also let loose thousands of brand-loyal customers who will eventually need another car.
R.L. Polk Associates estimates there are more than 18 million cars from 16 discontinued makes on the road today. Those "orphan owners" have sales-hungry competitors seeing dollar signs. GM is offering Saturn owners $1,000 cash toward a Chevy Cruze, Cadillac CTS or a GMC Acadia. Ford is giving its Mercury lease customers a chance to get out of their contracts with no early-termination penalty and offering to waive six remaining payments if they drive off in a Ford or Lincoln.
Edmunds.com research shows the efforts are paying off somewhat for GM, with 39 percent of Pontiac owners, 37 percent of Hummer owners and 31 percent of Saturn owners taking delivery of another GM-branded vehicle. But that leaves as much as 69 percent of owners going elsewhere. Ford, Honda and Toyota seem to be attracting many former GM owners.

Trump did talk to Bill Ford, but the Kentucky plant was never moving to Mexico

President-elect Donald J. Trump has been butting heads with Ford for a while now. A lot of it seems to stem from misunderstanding or misrepresenting facts about how the automaker currently does business and its plans for the future. After a sit-down with executive chairman Bill Ford Jr., the misunderstandings continue, but Trump has apparently convinced the company to make some changes. During his campaign, Trump claimed that Ford was going to fire US workers and move manufacturing to Mexico. That wasn't the case – yes, Ford planned to transfer Focus and C-Max production from Wayne, Michigan, to Cuautitlan, Mexico, but no, that wouldn't mean anyone losing their job. The Wayne plant will continue to operate, and likely busier than before, as it will be the home of the new Bronco and Ranger. So Ford CEO Mark Fields responded with the facts, and then chairman Bill Ford Jr. sat down with Trump over the summer. Things apparently weren't resolved to Trump's satisfaction, so he and Bill Ford spoke on the phone yesterday as he claims in this tweet: This content is hosted by a third party. First off, it's not a Lincoln plant, per se – the Louisville Assembly Plant currently builds the Ford Escape and Lincoln MKC, two small crossovers that share a platform. Ford was considering moving MKC production out of Kentucky to Mexico, but it would not have resulted in many lost jobs if any – the union had already agreed to moving the MKC in 2015 negotiations, and taking production of the slow-selling Lincoln out of the plant would open up capacity for more Fords. Be that as it may, Ford has decided not to move MKC production out of the plant, either for political reasons of placation or because it didn't make the greatest deal of business sense, maybe a combination of the two. That means Trump isn't really saving any American jobs in the short term. If anything, this move could keep Ford supply-constrained and result in reduced sales, which in turn brings the company less money and affects the bottom line and all employees. But that's speculation, so we won't tweet it. There is of course the possibility that Ford will be convinced, either by sheer will or by a more attractive trade situation, to invest in increased US production, which could bear fruit later on. Ford fights back against patent trolls

Some people are just awful. Some organizations are just as awful. And when those people join those organizations, we get stories like this one, where Ford has spent the past several years combatting so-called patent trolls. According to Automotive News, these malicious organizations have filed over a dozen lawsuits against the company since 2012. They work by purchasing patents, only to later accuse companies of misusing intellectual property, despite the fact that the so-called patent assertion companies never actually, you know, do anything with said intellectual property. AN reports that both Hyundai and Toyota have been victimized by these companies, with the former forced to pay $11.5 million to a company called Clear With Computers. Toyota, meanwhile, settled with Paice LLC, over its hybrid tech. The world's largest automaker agreed to pay $5 million, on top of $98 for every hybrid it sold (if the terms of the deal included each of the roughly 1.5 million hybrids Toyota sold since 2000, the company would have owed $147 million). Including the previous couple of examples, AN reports 107 suits were filed against automakers last year alone. But Ford is taking action to prevent further troubles... kind of. The company has signed on with a firm called RPX, in what sounds strangely like a protection racket. Automakers like Ford pay RPX around $1.5 million each year for access to its catalog of patents, which it spent nearly $1 billion building. "We take the protection and licensing of patented innovations very seriously," Ford told AN via email. "And as many smart businesses are doing, we are taking proactive steps to protect against those seeking patent infringement litigation." What are your thoughts on this?
