Fiat Chrysler to pay $40 million fine for inflating sales numbers

DETROIT — Fiat Chrysler is paying $40 million to settle with U.S. securities regulators who say the automaker misled investors by overstating its monthly sales numbers over a five-year period. The Italian-American company inflated sales by paying dealers to report fake numbers from 2012 to 2016, the U.S. Securities and Exchange Commission alleged in a complaint. Fiat Chrysler agreed to pay the civil penalty and to stop violating anti-fraud, reporting and internal accounting control regulations, the SEC said Friday in a statement. The automaker did not admit or deny the agency's allegations, the statement said. "This case underscores the need for companies to truthfully disclose their key performance indicators," Antonia Chion, associate director in the SEC's Enforcement Division, said in the statement. She noted that the new vehicle sales figures give investors insight into the demand for an automaker's products, a key to assessing the company's performance. Fiat Chrysler said it has reviewed and refined its sales reporting procedures. It said the payment will not have a large impact on its financial statements. The agency said the automaker boasted about a streak of year-over-year sales increases into 2016, when the streak actually was broken in September of 2013. When the company disclosed the sales scheme in 2016, it said that it had a "reserve" stock of cars that had been shipped to big fleet buyers such as rental car companies but not recorded as sales. The SEC said employees called this database of actual but unreported sales the "cookie jar." The company dipped into those sales to stop the streak from ending, or when it would have missed other sales targets. Fiat Chrysler said it now records sales as soon as vehicles are shipped to customers. It has also take steps to ensure that a sale is immediately subtracted from its books when it finds out the deal was scuttled because the buyer backed out or couldn't get financing. The SEC probe is another in a long string of legal troubles for Fiat Chrysler. It also faces federal investigations into illegal payments to union officials through a training center, and a criminal probe into allegations that its diesel-powered trucks were programmed to cheat on emissions tests. Fiat Chrysler to test automatically switching hybrid cars to electric mode in Turin

MILAN — Fiat Chrysler is piloting a project in its historic Italian home of Turin to allow its hybrid plug-in cars to automatically switch to electric-only mode when entering congested city centers. The project, which aims to maximize the environmental benefits of hybrid cars, comes as Fiat Chrysler (FCA) rolls out its first alternative-engine models, trying to make up ground on rivals which already offer a range of full electric and hybrid vehicles in Europe. The project, named 'Turin Geofencing Lab' and involving the city authorities and public transport agency GTT, is based on a prototype system with fully integrated on-board sensors allowing a car to recognize when it is entering a restricted traffic zone, FCA said on Wednesday. The sensors will then automatically turn off the combustion engine and switch to electric mode. This would allow hybrid cars to enjoy dispensations for electric vehicles in the city center, including dedicated parking spaces. The system has been initially tested on the new Jeep Renegade 4xe hybrid plug-in model. The tests could be extended to the group's other hybrid models from next year. The COVID-19 crisis has not significantly delayed FCA's plans to launch its first full-electric and hybrid models. An electric version of the Fiat 500 small car and plug-in hybrid versions of Jeep's Renegade and Compass models are due to hit the market this summer. A similar project was launched last year by German carmaker BMW and Rotterdam, with a smart-phone reminder to switch-off combustion engines when passing a virtual boundary into the Dutch city's "electric-only zone." But that did not entail such a direct link between the vehicle and the city's access platform and gates to restricted traffic zones, as in Turin's case. There are some companies that could change leadership overnight and still remain more or less the operations that they are. But some have built themselves up around one central figure. Just ask Carlos Tavares, who found he couldn't escape the long shadow of Renault-Nissan CEO Carlos Ghosn. Tavares recently left to find his own limelight. But Ghosn isn't the only executive who presides over two disparate automakers on opposite ends of the globe.
Having built up Fiat and Chrysler around himself, we can hardly imagine either automaker getting along without Sergio Marchionne. But the day will come when the famously sweater-clad bigwig will step down. The pressing questions remain when when that day will come, and who will take his place. The only solid clues we have are in the statements made mostly by Marchionne himself, but those statements have been all over the place. When speaking to Automotive News in 2012, he said he would step down "no earlier than 2013, no later than 2015." But a year later, he had already seemingly changed his tune, indicating he could still be at the helm in 2016. Fiat chairman John Elkann seems to think Marchionne, 61, could and should stay on longer.
