Federal judge throws out GM's racketeering lawsuit against Fiat Chrysler

  DETROIT — A federal judge on Wednesday threw out a racketeering lawsuit General Motors had filed against smaller rival Fiat Chrysler Automobiles, saying the No. 1 U.S. automaker's alleged injuries were not caused by FCA's alleged violations. GM officials said in statement they "strongly disagree" with the order by U.S. District Court Judge Paul Borman, whom the automaker had sought to have removed from the case, and would appeal. "There is more than enough evidence from the guilty pleas of former FCA executives to conclude that the company engaged in racketeering, our complaint was timely and showed in detail how their multi-million dollar bribes caused direct harm to GM," GM said in a statement. The Detroit company added that Borman's decision "would let wrongdoers off the hook." GM filed the racketeering lawsuit against FCA last November, alleging its rival bribed United Auto Workers (UAW) union officials over many years to corrupt the bargaining process and gain advantages, costing GM billions of dollars. GM was seeking "substantial damages" that one analyst said could have totaled at least $6 billion. FCA had called the case meritless and asked Borman to dismiss it. On Wednesday, Borman dismissed the lawsuit "with prejudice," meaning GM cannot refile the complaint. "The direct victims of defendants' alleged bribery scheme are FCA's workers," Borman wrote of FCA. "GM's high labor costs were not an injury proximately caused by FCA's bribes, and any competitive injury that GM suffered as a result of FCA's advantage in labor costs is an indirect injury." "The dismissal of GM's complaint with prejudice earlier today vindicates our position," FCA said in a statement. On Monday, the Sixth U.S. Circuit Court of Appeals denied GM's petition to remove Borman from the case, but said the two automakers' chief executives didn't have to meet to try to settle the case as Borman had ordered. Ford barely edges surging Chrysler for Canadian sales crown in best year ever

The auto industry in the US showed strong results through much of 2014 with sales regularly growing year-over-year for many brands. That same trend carried over in the Great White North, as well. Canada posted its best numbers ever with 1.85 million units sold, up about 100,000 vehicles over 2013. The country nearly had a new market leader, too. The big winner among our neighbors to the north in 2014 was Ford with 291,951 vehicles sold, up 3 percent from 2013, according to Reuters. That success also handed the company the sales crown for the fifth consecutive year. In large part, the strong result came from the company's popular trucks, which represented about 80 percent of overall sales. "Ford moved into the number one position in September and didn't look back," said a note to clients by DesRosiers Automotive Consultants quoted by Reuters. However, the Blue Oval didn't exactly take an overwhelming lead for the year. The company nearly had to hand over the sales trophy to FCA after the company rallied in the latter part of the year. The Italian-American conglomerate had its best results ever to nip at the Ford's heels and move 290,004 units for 2014, a 12-percent improvement from last year. Jeep especially helped the bottom line with over 50-percent growth, according to Reuters. Only two other brands were able to break the 200,000-vehicle barrier in Canada for 2014. General Motors came in third place overall with 249,800 sales, up 6.3 percent. The combined Toyota and Lexus also barely jumped the hurdle with 200,851 units moved, a 2.8 percent improvement.

Chrysler recalls 112k family-haulers over airbag controllers

The Basics: Chrysler has issued a recall for an array of minivans and crossovers manufactured in 2007 and 2008. The models affected include the 2009 Dodge Journey, 2008-09 Dodge Grand Caravan, and 2008-09 Chrysler Town and Country. The 2009 Volkswagen Routan, which was manufactured by Chrysler, is also being recalled by FCA. The automaker estimates that 112,001 units in the United States are affected, all told. The Problem: Corrosion in the air bag control unit could prevent the air bags from deploying in the event of a crash, or alternatively deploy prematurely. Chrysler points out that "none of the affected vehicles are equipped with ammonium-nitrate inflators" like those fitted by Takata. Injuries/Deaths: The manufacturer reports seven minor injuries (but no accidents) potentially related to this issue. The fix: Chrysler will replace the air bag control unit, though it has not yet outlined a timeframe for doing so.
