Former Chrysler dealers could reopen under appeals court ruling

Years after the bankruptcies and subsequent bailouts of Chrysler (now FCA) and General Motors, the automotive industry is still seeing legal decisions about them come through the courts. The latest ruling from a US appeals court has given 4 of the 789 dealers that Chrysler closed in its Chapter 11 process one less hurdle towards reopening. Following the bankruptcy, 105 of the shuttered dealers went through an arbitration process in hopes of reopening, and 32 won their arguments. However, a victory in that undertaking didn't necessarily mean that the stores could reestablish themselves. For these three showrooms in Michigan and one in Las Vegas, state laws allowed nearby competitors from the same automaker to stand in the way of restarting, according to Automotive News. This problem brought yet another lawsuit, and a US district court found that the arbitration decisions did not overrule state laws. The latest appeals court ruling overturned that decision. However, as with many legal proceedings, the process for reopening for these dealers still isn't exactly easy. The latest decision only covers the nearby dealers' ability to protest; it doesn't mandate FCA actually to open the stores again. According to a statement from Michael Palese of FCA legal communications to Automotive News, the ruling, "did not provide for reinstatement of the dealers who prevailed in arbitration, but only gave them a right to a 'customary and usual' letter of intent." It means for these showrooms to start selling again, now they need to work things out with Chrysler's new owner.

Marchionne backs off merger plans, could retire after 2018

FCA boss Sergio Marchionne is stepping back from plans to attempt a major auto industry merger like the oft-speculated deal with General Motors last year. According to Bloomberg, Marchionne now wants to grow his automaker through 2018, and then the 63-year-old could retire around the end of that year. Marchionne claims he received merger proposals last year, but he couldn't find an attractive enough partnership. "We went back to concentrate on the 2018 plan which would boost Fiat Chrysler's value and its position in a deal," he said to Bloomberg. He still believes that a big merger is possible, but "it will be someone else's duty," he said after previously hinting about possibly staying at FCA until 2020. Marchionne was clear that any chance for the GM merger was likely over. "I met Mary Barra less than a month ago in Washington," he told Bloomberg. "I don't think I will have another coffee with her. It won't happen again in the future." Now, the boss intends to spend the rest of his time at FCA building the automaker through its five-year plan, and his goal is to grow global deliveries to seven million units a year by 2018. To make that happen, the automaker will invest around $52 billion over that time to improve its brands' product slate. Marchionne began backtracking from the possible GM merger late in 2015 after it became clear that The General's board wasn't interested. Earlier in the year, he seemed more aggressive about the prospect by suggesting a hostile takeover with a bizarre metaphor about giving the company a hug. FCA's large, LX-based RWD cars will stick around until 2020

Fiat Chrysler Automobiles plans to stick with the Dodge Challenger, Dodge Charger, and Chrysler 300 until at least 2020, reports Automotive News. The information comes from two unnamed sources and was loosely confirmed by details in the automaker's new labor contract with Unifor, Canada's auto union. The plan, according to two anonymous sources, is to lightly refresh the Challenger, Charger, and 300 until the vehicles make the switch to FCA's new Giorgio platform. The refresh, as Automotive News points out, will happen in 2018. The Giorgio platform currently underpins the Alfa Romeo Giulia and is expected to find its way to two of the three large American vehicles for the 2021 model year. At that time, FCA will discontinue either the Charger or the 300, claim AN's unnamed sources. If one of the vehicles were to go, it would most likely be the 300. The 300's LX platform would be approximately 15 years old in 2020 and the vehicle doesn't draw in as many sales as the Challenger or the Charger. The Charger made the switch from the LX platform in 2010 with the current model utilizing the mildly updated LD platform, while the Challenger recently moved from the LC platform to the LA platform last year. All of those rear-wheel-drive platforms are closely related. Automotive News points out that FCA CEO Sergio Marchionne stated that the new platform could be utilized across various applications in a conference call with analysts last month. The plan, according to the report, is to stretch and widen the Giorgio platform for the next-gen Challenger and Charger. The new platform is also rigid enough to allow the automaker to add a convertible to its lineup, which could lend further credence to rumors of an upcoming Barracuda. Hopefully, the move to the new Giorgio platform doesn't delay the all-wheel-drive Challenger GT AWD or the wide-body, Hellcat-powered Challenger ADR. We'll just have to wait and see.
